Applicant’s Request

The application for discharge review was received on 20030122. The Applicant requests the characterization of service received at the time of discharge be changed to entry level separation or uncharacterized. The Applicant requests a personal appearance discharge review before a traveling panel closest to Merced, CA 95348. The Applicant did not list any representative on the DD Form 293. In the acknowledgement letter, the Applicant was informed that the Naval Discharge Review Board (NDRB) does not travel; all hearings are held in the Washington, D.C. area. The NDRB also advised that the Board first conducts a documentary review prior to any personal appearance hearing.


Decision

A documentary discharge review was conducted in Washington, D.C. on 20031229. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: MARCORSEPMAN 6210.5.

1. “I believe my discharge was inequitable because I do believe what I did was wrong but I do not believe that I received fair punishment. During my school of infantry (S.O.I) I tested positive for drugs. I then was NJP and given an other then honorable discharge with an R.E. Code that does not allow me to hold any federal employment. I understand that what I did was very wrong, but I was young and irresponsible. All I have ever wanted to do is be a Marine. To this day, this is still the case. Because of one bad judgement I am banished from the military. I have been extremely disappointed in my self for the last 5 ½ years. I never even have had an opportunity to explain my self, I was told if I went threw with a court martial I could spend time in the brig. I am now pleading for someone to hear my side. I WANT TO BE A MARINE AGAIN.”

980105:  Applicant refused evaluation by a medical officer.


980116:  NJP for violation of UCMJ, Article 112A:
Specification: Wrongfully used a controlled substance, to wit: tested positive for methamphetamines on a urinalysis conducted on 971201.
Awarded forfeiture of $450.00 per month for 2 months, restriction and extra duties for 45 days, reduction to Pvt. Not appealed.

980202:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse.

980202:  Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

980202:  Commanding Officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse. The factual basis for this recommendation was Pvt M_’s (Applicant’s) wrongful use of illicit drugs. On 1 December 1997, Pvt M_ (Applicant) tested positive on a urinalysis for illegal use of methamphetamine, which was later adjudicated at nonjudicial punishment. Additionally, Pvt M_ (Applicant) was granted a drug waiver to enlist. His willful use of illicit drugs is a direct violation of the Marine Corps’ policy on drug abuse and constitutes a flaunting of authority and that policy.

980212:  GCMCA [Commanding General, Marine Corps Base, Camp Pendleton, CA] directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19980306 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1. There is credible evidence in the record that the Applicant used illegal drugs. Drug abuse warranted processing for separation. Separation under these conditions generally results in characterization of service under other than honorable conditions. Relief denied.

The NDRB has no authority to change reenlistment codes or make recommendations to permit reenlistment, reentry, or reinstatement into the Naval Service or any other branch of the Armed Forces. Neither a less than fully honorable discharge nor an unfavorable “RE” code is, in itself, a bar to reenlistment. A request for waiver is normally done only during the processing of a formal application for enlistment through a recruiter.

The Applicant’s discharge characterization accurately reflects his service to his country.
Normally, to permit relief, an error or inequity must have existed during the period of enlistment in question. No such error or inequity is evident during the Applicant’s enlistment. Additionally, there is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. Relief not warranted.

The Applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received at the NDRB within 15 years from the date of his discharge. Representation at a personal appearance hearing is recommended but not required.
