Applicant’s Request

The application for discharge review, received 020612, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a documentary record discharge review. The Applicant listed the American Legion as the representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 030410. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity at the time of discharge. However,
after review of the evidence the Applicant provided, the Board determined that partial relief is warranted under equitable grounds based on post-service conduct. The Board’s vote was unanimous that the character of the discharge shall change to GENERAL (UNDER HONORABLE CONDITIONS) and that the reason for the discharge shall remain the same. The discharge shall change to: GENERAL (UNDER HONORABLE CONDITIONS)/MISCONDUCT, authority: NAVMILPERSMAN, Article 3630620.

1. (Equity Issue) His violations of the UCMJ notwithstanding, this former member opines that the length and quality of his overall service record warrants a higher characterization of service.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 940407 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B).

After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the NDRB discerned there was no impropriety or inequity in the characterization of the applicant's service or the assigned reason for discharge, at the time of discharge (C and D). In addition, the Board disagreed with the Applicant’s assertion that his overall service record warrants a higher characterization of service. However, after consideration of the Applicant's post service documentation, the Board determined that partial relief is warranted on the basis of equity. The Board determined that the seriousness of the applicant's misconduct prevented changing the discharge characterization to fully Honorable. The Board voted unanimously to change the character of the Applicant’s discharge to General (Under Honorable Conditions)/ Misconduct.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide additional documentation to support any further claims of post-service accomplishments at that time. Representation at a personal appearance hearing is recommended but not required.
