Applicant’s Request

The application for discharge review, received 000629, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant listed the Veterans of Foreign Wars as his representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010209. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 1910-146, formerly Article 3630620.

990111:  NJP for violation of UCMJ, Article 112A: Wrongful use of controlled substance on 30Nov98.
         Award: Forfeiture of $637 per month for 2 months, restriction for 30 days, reduction to AKAN. Forfeiture suspended for 6 months. No indication of appeal in the record.

990204:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse.

990204:          Applicant advised of his rights and having consulted with counsel certified under UCMJ Article 27B, elected to appear before an Administrative Discharge Board.

990412:  An Administrative Discharge Board, based upon a preponderance of the evidence and by unanimous vote, found that the applicant had committed misconduct due to drug abuse, that the misconduct warranted separation, but suspended for 6 months and recommended discharge under other than honorable conditions.

990728:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse (use). Commanding Officer's comments (verbatim): AKAA (applicant) tested positive for marijuana after participating in a urinalysis on 30 Nov 98. He admitted his guilt at NJP and later elected his right to an administrative board. As evidence by enclosure (1), the board found misconduct and recommended separation under Other Than Honorable conditions (suspended for six months). The defense through enclosure (2) concurs with the board's recommendation and requests a favorable endorsement. After deliberating with the recommendation of the board and the request made by the defense, I have decided that his case does not warrant a suspension. Therefore, I strongly recommend separation immediately under Other Than Honorable conditions.

990920:  CNMPC directed the applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 990920 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The Board found that the applicant’s discharge of other than honorable for misconduct, admitted marijuana use, accurately characterized the applicant’s service. The applicant’s issue that “had he the benefit of rehabilitation and recovered, it would have led to an Honorable Discharge or a General Discharge.” is without merit. The applicant admitted to a “one time use” of marijuana at his Administrative Board. The applicant failed to provide documentation to support that he was drug dependant. Further, the applicant provided no post service documentation to support his sobriety for the Board’s consideration. Relief is not warranted.

The applicant is reminded that he is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is highly recommended.
