Applicant’s Request

The application for discharge review, received 020226, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 021029. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – commission of a serious offense, authority: NAVMILPERSMAN, Article 3630600.

1. To the board of review my name is A_ A_ (Applicant) and am I asking that my OTH discharge be upgraded to Honorable discharge. I have been more than a model citizen, I am a father of three boys, and I am also a pastor of a local church. I am involved in my community as far as making a different in the lives of the people who I come in contact with. I love my country and I support it as well. I am sending my pastoral appointment license alone with ordination license for your review. I have made a valiant effort to turn my life around and I hope you will all be able to see that and grant me my request. Thank you for your time. Sincerely A_ A_ (Applicant).

900225:  Applicant retained in the Naval service, despite defective enlistment and induction due to fraudulent entry into the naval service as evidenced by failure to disclose pre-service civil involvement: Possession of marijuana, 1986, Los Angeles, CA (6 months probation). However, any further deficiencies in performance or conduct may result in processing for separation.

920713:  Commanding Officer recommended discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense. Commanding Officer’s comments (verbatim): [SR A_ (Applicant’s) attitude is poor, his performance always minimal. He is a constant problem to his division and the CALIFORNIA. SR A_ (Applicant) often stated overwhelming desire to be out of the Navy. He represents a continual risk of flight. This is highlighted by non-judicial punishment and a summary court-martial.]

920807:  BUPERS directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 920814 under other than honorable conditions for misconduct due to commission of a serious offense (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issue 1:
The NDRB, under its responsibility to examine the propriety and equity of an Applicant's discharge, will change the reason for discharge if such a change is warranted. Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. No such error or injustice occurred during the Applicant’s enlistment. The summary of service clearly documents the Applicant’s willful disregard for the requirements of military discipline and demonstrated he was unfit for further service. The Applicant’s service is marred by award of non-judicial punishment as well as a Summary Court Martial. Under other than honorable conditions most clearly describes the Applicant’s character of service.

There is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the Applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the Applicant to claim post-service conduct and behavior as a reason to upgrade a less than honorable discharge. The post-service documentation submitted by the Applicant does not mitigate his conduct while on active duty, and therefore an upgrade based upon post-service conduct is not warranted. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Representation at a personal appearance hearing is recommended but not required.
