Applicant’s Request

The application for discharge review, received 000202, requested that the characterization of service on the discharge be changed to Honorable. The applicant requested a personal appearance hearing discharge review before the board in the Washington National Capitol Region. The applicant did not list any representative on the DD Form 293. In the acknowledgement letter to the applicant, he was informed that the Naval Discharge Review Board (NDRB) first conducts a documentary review prior to any personal appearance hearing.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000928. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct - Pattern of Misconduct, authority: NAVMILPERSMAN, Article 3630600.

The NDRB did note an administrative error on the original DD Form 214. Block 24, Character of Service should read: “UNDER OTHER THAN HONORABLE CONDITIONS” vice “OTHER THAN HONORABLE”. The original DD Form 214 should be corrected or reissued as appropriate.


PART I - APPLICANT’S ISSUES AND DOCUMENTATION

1. I write this letter with regard to a review of my military discharge. I was given a general discharge under other than honorable conditions. Although many mistakes were made during my enlistment from 1988-1991, I feel that overall my time served in the U.S. Navy is deserving of an honorable discharge.

In 1989 I attended and completed search and rescue surface swimmer training in San Diego, California. I went on to become the search and rescue swimmer for the command, which I served (USS Kiska AE-35). While on board USS Kiska I became a highly qualified wench operator during underway replenishment operations in the Persian Gulf War. During our 10-month deployment we transferred more munitions than any other command. During my time aboard ship, I enthusiastically participated in all ship sponsored sporting events and activities. Although never able to keep climbing in rank I was recognized as a leader amongst my peers in 2
nd Division.

I am now married and starting a family. I have been employed with Frazee Industries of San Diego, California for over five years. My current position is Territory Sales Manager for San Gabriel and San Fernando Valleys. With three promotions in the last three-year, my future with Frazee looks bright.

My family has a history with the US Navy, dating back to World War II. Starting with my grandfather T G volunteering in 1942 to serve during the war. In 1957, my uncle T G Jr., attended the Army Language School, learning to speak fluent Russian and serving through 1960. Currently my cousin T G III is serving as an officer after having climbed through the enlisted ranks and completed the Officer Candidate School.

The three years I spent in the Navy taught me more about myself than any other period in my life. I learned from the mistakes that I made while in the Navy, and for that reason, I'm able to succeed as a civilian today. I would hope that serious consideration be given to my review, believing fully that my three years of service to my country was done honorably. Thank you for your time and consideration.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 910822 under Other Than Honorable conditions for misconduct due to a Pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In the applicant’s issue 1, the Board determined this issue is without merit. The applicant states his overall time served in the U.S. Navy is deserving of an Honorable discharge, he is married and starting a family and has been employed for five years. The applicant’s length of active service was 2 years and 11 months. Three months after enlistment he received a retention warning for unauthorized absence and dereliction of duty. His misconduct, including four NJPs and three additional retention warnings, continued throughout his enlistment until he was recommended for separation. The Board was unable to identify any significant portion of the applicant’s service that was honorable. The applicant provided no documentation of post-service accomplishments
for the Board to consider. This discharge was proper and equitable. Relief denied.
