Applicant’s Request

The application for discharge review, received 011210, requested that the characterization of service on the discharge be changed to honorable. The Applicant requested a personal appearance hearing before the board in the Washington National Capital Region. The Applicant listed the American Legion as the representative on the DD Form 293.


Decision

A personal appearance discharge review was conducted in Washington, D.C. on 030519. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the Applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: MARCORSEPMAN 6210.5.

Chronological Listing of Significant Service Events :

960912:  Applicant briefed upon and certified understanding of Marine Corps policy concerning illegal use of drugs.

990107:  Applicant apprehended by customs for possession of valium. Applicant turned over to Shore Patrol for further disposition. NCIS was notified and arrived to conduct investigation. NCIS departed. Applicant was transferred to MCRD for further disposition.

990202:  Applicant not recommended for promotion to corporal (E-4) for January, February, and March due to lack of maturity.

990212:  Counseled for deficiencies in performance and conduct (possession of a controlled substance, valium, while crossing the international border between Tijuana, Mexico and San Diego, CA, United States). Necessary corrective actions explained, sources of assistance provided, disciplinary and discharge warning issued.

990217:  NJP for violation of UCMJ Article 112a:
Specification: Wrongfully possess 78 tablets of valium at 1225 on 990107.
Awarded forfeiture of $250.00 per month for 2 months, restriction and extra duties for 45 days, reduction to PFC. Forfeiture of $200.00 for 2 months, restriction and extra duty for 15 days suspended for 4 months. Not appealed.

990406:  Applicant refused medical officer's evaluation for addictions prior to discharge.

990413:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse.

990413:  Applicant advised of his rights and having consulted with counsel certified under UCMJ Article 27(b), elected to appear before an Administrative Discharge Board.

990426:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse. The factual basis for this recommendation was the documented possession of an illegal substance.

990518:  An Administrative Discharge Board, based upon a preponderance of the evidence and by unanimous vote, found that the Applicant had committed misconduct due to drug abuse, that the misconduct warranted separation, and recommended discharge under other than honorable conditions.

990726:  SJA review determined the case sufficient in law and fact.

990726:  GCMCA (Commanding General, 1
st Force Service Support Group) directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 990728 under other than honorable conditions for misconduct due to drug abuse (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Issues 1: The Applicant contends, through counsel, that his post-service conduct,
to include continuing education, professional pursuits in law enforcement, and community involvement, warrants reconsideration of his characterization of service. There is no law or regulation that provides for an unfavorable discharge to be upgraded based solely on the passage of time or good conduct in the civilian life subsequent to leaving the service. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the Applicant's performance and conduct during the period of service under review, may be considered. The Board did consider the post-service documentation provided by the Applicant as well as the additional post-service accomplishments revealed during his testimony and does acknowledge the Applicant's positive accomplishments and service to his community. However, the evidence provided by the Applicant to the Board was deemed insufficient to warrant a recharac-terization of his discharge to honorable. Relief on the basis of post-service conduct is therefore denied.
