Applicant’s Request

The application for discharge review, received 010709, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant listed the American Legion as the representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 020130. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – Drug abuse (Use), authority: NAVMILPERSMAN, Article 3630620.

891010:  Medical evaluation for drug abuse found the applicant to be a drug abuser, not drug dependent.

891109:  Drug and Alcohol Abuse Report: Cocaine abuse, less than monthly, ashore off duty. Random urinalysis 890830. CAAC and physician found applicant not dependent and recommended separate. Commanding officer recommended separate. Comments: MMFA (applicant's) work performance has been generally good. However he has proven through numerous infractions of the UCMJ, culminating in drug abuse that he has no potential for further misconduct.

890926:  Applicant notified of intended recommendation for discharge under other than honorable conditions by reason of misconduct due to drug abuse as evidenced by testing positive for cocaine during a random sample urinalysis conducted on 30 August 1989 and confirmed by NAVDRUGLAB NORFOLK, VA 180850Z Sep 89.

890926:  Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

891027:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).

891103:  CNMPC directed the applicant's discharge under other than honorable conditions by reason of misconduct due to drug abuse (use).


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 891109 under other than honorable conditions for misconduct due to drug abuse (use) (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The NDRB reviewed the applicant’s service record and found the applicant had nine NJP’s in his enlistment. The Board found no impropriety or inequity in the discharge.

The applicant’s issue states:
“(Equity Issue) This former member requests that the Board apply provisions of SECNAVINST 5420.174C, enclosure (1), Chapter 9, as it pertains to post-service conduct, in assessing the merits of this application.” The NDRB is authorized to consider post-service factors in the recharacterization of a discharge. There is no law or regulation allows an unfavorable discharge to be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review, may be considered by the NDRB. Although the applicant provided a significant amount of post service documentation, the Board did not find it sufficient to warant upgrading his discharge, as described in SECNAVINST 5420.174C, enclosure 1, Chapter 9. The Board found the applicant’s service was properly and equitably characterized. Relief is denied.

The applicant remains eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is recommended .
