Applicant’s Request

The application for discharge review, received 011018, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a personal appearance hearing before the board in the Washington National Capital Region. The applicant listed the American Legion as the representative on the DD Form 293.

Decision

A personal appearance discharge review hearing was conducted in Washington, D.C. on 020923. After a thorough review of the testimony, records, supporting documents, facts and circumstances unique to this case, NDRB discerned no impropriety but did discern an inequity in the characterization of the applicant’s service. The Board’s vote was three to two that the character of the discharge shall change. The discharge shall change to: UNDER HONORABLE CONDITIONS (GENERAL)/Misconduct- commission of a serious offense, authority: NAVMILSPERSMAN, Article 3630600.
A personal appearance discharge review was conducted in Washington, D.C. on XXXXXX. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct – commission of a serious offense, authority: NAVMILPERSMAN, Article 3630600.

Commanding Officer’s comments: applicant's record accurately reflects his failure to make any attempt to adjust to military life. His service thus far has been characterized by a series of disciplinary infractions that display his refusal to conform to barest standards of behavior. His work performance has been lackluster at best. I strongly recommend he be discharged with an other than honorable discharge as soon as possible. Applicant is presently assigned TAD to Transient Personnel Unit, Subic Bay, R.P.

870328:  CNMPC directed the applicant's discharge under other than honorable conditions by reason of misconduct due to the commission of a serious offense.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 870529 under other than honorable conditions for misconduct due to the commission of a serious offense (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that although the discharge was proper and equitable at the time of issuance, it is no longer equitable in light of evidence presented to the Board (C and D).

Issue 1. The Board found that the applicant’s post-service conduct was sufficiently creditable to warrant an upgrade of his characterization of service to under honorable conditions (general). The applicant’s successful completion of substance abuse treatment, volunteer service, career progression, and strong references demonstrated that the applicant possessed character and drive that was not evident during his tour of active duty. However, the Board found that the applicant’s post-service conduct does not sufficiently mitigate his misconduct while on active duty to warrant full relief in the form of an honorable discharge. Therefore partial relief is granted.
