Applicant’s Request

The application for discharge review, received 000523, requested that the characterization of service on the discharge be changed to honorable and the reason for the discharge be changed to early separation. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010201. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct-Pattern of misconduct (administrative discharge board required but waived), authority: MARCORSEPMAN Par. 6210.3.




PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. The character of my discharge was not appropriate based on my military service. I was lead to believe that acceptence of the discharged recieved was in the best intrest of the naval service and myself. Statements on the discharge are inaccurate and misleading. I served faithfully and accepted responsibility for an isolated incident. I feel that the discharge recieved is an extension of punishment for the incident and does not fit the offense commited. Furthermore, I have prior military service without incident and was granted a RE 1 re-enlistment code. The Marine Corps' decision to assign a RE 4 code is a miscarriage of justice to the Armed services.

Specification 2: Make and utter check #582 to MWR 0150 for the amount of $12.79 and did thereafter dishonorably fail to maintain sufficient funds for payment on 920719.

Awarded restriction and extra duties for 7 days. Not appealed.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 940607 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

In the applicant’s issue, the Board found nothing to substantiate his allegations that the discharge was inaccurate or misleading. The Board did find that the applicant’s record was clearly not honorable. During his period of active duty the applicant received 2 NJP’s and 2 counseling entries, clearly a pattern of misconduct existed. These were not isolated incidents, to include his 49 days of UA, as he contends. The applicant was correctly discharged and given the appropriate RE code. Relief denied.

The applicant is reminded that he is eligible for a personal appearance hearing in the Washington, D.C. area provided his applicant is received within 15 years from the date of his discharge. Proof of community service, over and above his service provided as a Deputy Sheriff, is encouraged.
