Applicant’s Request

The application for discharge review, received 010309, requested that the characterization of service on the discharge be changed to honorable and the reason for the discharge be changed to expiration of enlistment. The applicant requested a personal appearance hearing discharge review before a traveling panel. The applicant listed American Legion as his representative on the DD Form 293. In the acknowledgement letter to the applicant, he was informed that the Naval Discharge Review Board (NDRB) does not travel, all hearing are held in the Washington, DC Area.


Decision

A personal appearance hearing discharge review was conducted in Washington, D.C. on 011002. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was three to two that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct - Pattern of misconduct, authority: NAVMILPERSMAN, Article 3630600.

861229:  An Administrative Discharge Board, based upon a preponderance of the evidence and by unanimous vote, found that the applicant had committed misconduct due to a pattern of misconduct and commission of a serious offense, that the misconduct warranted separation, and recommended discharge under other than honorable conditions.

PART III – RATIONALE FOR DECISION AND PERTINENT
REGULATION/LAW

Discussion

The applicant was discharged on 861231 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant’s representative submitted the following as the applicant’s issue:
As evidenced by his supporting documentation and testimony, this former member opines that his post-service conduct has been sufficiently creditable to warrant the Board’s clemency relief with recharacterization of his service period to Honorable, as authorized under provisions of SECNAVINST 5420.174C, enclosure (1), paragraph 9.3.”
The Board took into full consideration the applicant’s entire service record, and supporting documentation provided. The Board determined that the applicant’s post-service accomplishments were not substantial enough to mitigate his poor personal conduct and overall performance while serving in the U.S. Navy. The applicant’s misconduct, which included five NJPs and two retention warnings, diminished the quality of his service record to a point where only extraordinary post-service accomplishments and documentation would warrant recharacterization of service to Honorable. The Board determined that the applicant’s discharge was proper and equitable. Therefore, relief is denied.

This decision exhausts the applicant’s opportunity for further review by the NDRB. The applicant has had a document review, and a personal appearance hearing. The applicant is encouraged to submit any further appeals for recharacterization of his discharge to the Board of Correction of Naval Records (BCNR).
