Applicant’s Request

The application for discharge review, received 000728, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a personal appearance hearing before the board in the Washington National Capital Region. The applicant did not list any representative on the DD Form 293. In the acknowledgement letter to the applicant, the applicant was informed that the Naval Discharge Review Board (NDRB) first conducts a documentary review prior to any personal appearance hearing.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010201. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct - Pattern of misconduct, authority: NAVMILPERSMAN, Article 3630600.

Issues

1. I was in the psychologist ward in 1987-88 an they let me out saying nothing was wrong with me.

In 1994 I was ship to Warren State Mental Hospital and upon finishing the test the doctors and psyhc had done the said I was a manic depressed Bi polar person and I had this all my life and that the reason I tried to commit suicide in the military is because it was finally coming out and that why my attitude was the way it was.

880712:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to commission of a serious offense, misconduct due to a pattern of misconduct and a personality disorder. Commanding officer’s comments (verbatim): Counseling requirements met IAW MILPERSMAN 3630600. SNM signed page 13 entries on 30 July 1987 and 13 November 1987. AR (applicant) shows no potential for further service as demonstrated by his total disregard for military discipline and extreme lack of trustworthiness. Even after many formal and informal counseling sessions, he requires constant supervision by his superiors, takes no pride in his personal appearance, and has shown no initiative to improve himself. His presence in this command continues to be a complete detriment to good order and discipline. His numerous bad checks have brought discredit to the Navy and have no doubt hurt the possibility for other Navy personnel to write or cash checks at local civilian establishments. Recommend he be discharged under other than honorable conditions by reason of misconduct due to commission of serious offenses, misconduct due to a pattern of misconduct, and a personality disorder.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 880728 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant’s issue discussed his mental state. The NDRB found that while the applicant’s mental condition was noted while on active duty, competent medical authority noted that the applicant was responsible for his actions. Accordingly, the applicant was held accountable for his misconduct and properly processed for discharge. Relief is not warranted.

The applicant is reminded that he is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is highly recommended.
