Applicant’s Request

The application for discharge review, received 000111, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant designated the American Legion as his representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000831. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: BAD CONDUCT DISCHARGE/As a result of a courts-martial (SPCM) – Other, authority: MARCORSEPMAN Par. 1105.

(Equity Issue) Pursuant to 10 USC 874(b) (UCMJ Article 74) and in accordance with SECNAVINST 5420.174C, enclosure (1), paragraphs 2.24 and 9.3, this former member requests the Board's clemency relief with up-grade of his characterization of service to under honorable conditions on the basis of his post-service conduct.

860506:  NJP for violation of UCMJ, Article 86: failed to go at the time prescribed to his appointed place of duty, without authority, Bks M-507B, 0200, 860421, FSSCo, MCSSS, MCB, Camp Lejuene for fire security watch; violation of UCMJ Article 92: having knowledge of a lawful order issued by CO, MCSSS, par 7d(2), ScolsO 1050.1N dtd 840926, violated same on 860420, by failing to check out on liberty.
         Award: Forfeiture of $200 per month for 2 months, restriction for 14 days. Not appealed.

860506:  Counseled for deficiencies in performance and conduct [NJP of 860506] Necessary corrective actions explained, sources of assistance provided, disciplinary and discharge warning issued.

860822:  NJP for violation of UCMJ, Article 92: having knowledge of a lawful order issued by the Commanding Officer, CSSD-18, not to go on off base liberty unless authorized, did on onboard Camp Wilson, 29 Palms, CA on or about 0214, 860815, fail to obey the same; violation of UCMJ, Article 86: on or about 0214, 860815, without authority, absent himself from his place of duty, to wit: Camp Wilson, 29 Palms, CA, and did remain so absent until on or about 1800, 860819; violation of UCMJ, Article 134: on or about 0214, 860815, drunk, which conduct was of a nature to bring discredit upon the Armed Forces.

         Award: Forfeiture of $358 per month for 1 month (suspended for 6 months), restriction and extra duty for 30 days. Not appealed.

860827:  Vacated the suspended portion of the sentence awarded on 860822.

870128:  Summary Court-Martial.
         Charge I: violation of the UCMJ, Article 128.
         Specification: on or about 860826, assault Cpl R_, USMC, by swinging at him with his fists.
         Charge II: violation of the UCMJ, Article 134 (2 Specifications).
         Specification 1: on or about 860826, drunk and disorderly, which conduct was of a nature to bring discredit upon the armed forces of the United States.
         Specification 2: on or about 860826, wrongfully communicate to Sgt J.R. R_ a threat to kick him in the back of the head.
         Add Charge I: violation of the UCMJ, Article 117.
         Specification: on or about 861011, wrongfully use provoking words, to wit: "If you don't get out of my room, I'm going to kick your ass." And "Get out or get f----ed up", or words to that effect, towards PFC R.G. W_, USMC.
         Add Charge II: violation of the UCMJ, Article 128.
         Specification: on or about 861011, unlawfully strike PFC R.G. W_, USMC, by pushing the said PFC R.G. W_ on the body with his hands.

         Finding: to Charge I and the specification thereunder, guilty except the words "by swinging at him with his fists" substituting therefore "offering to do bodily harm using menacing gestures".

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 880806 with a bad conduct discharge which was the sentence adjudged by a properly constituted special court martial that was determined to be legal and proper, affirmed in the legal chain of review and executed (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

The applicant's issue states: "(Equity Issue) Pursuant to 10 USC 874(b) (UCMJ) Article 74) and in accordance with SECNAVINST 5420.174c, enclosure (1), paragraphs 2.24 and 9.3, this former member requests the Board's clemency relief with up-grade of his characterization of service to under honorable conditions on the basis of his post-service conduct." The NDRB did not find the applicant's post service documentation enough to warrant clemency relief of the Bad Conduct Discharge. Relief is not warranted.

The applicant is highly encouraged to make a personal appearance before the NDRB. Documentation of the applicant's post service conduct including sobriety, police records, and community service are of particular interest to the NDRB. Representation at the personal appearance hearing is encouraged.

Pertinent Regulation/Law (at time of discharge)

A. Paragraph 1105, DISCHARGE ADJUDGED BY SENTENCE OF COURTS-MARTIAL, of the Marine Corps Separation and Retirement Manual, (MCO P1900.16C), effective 821001 until 890626.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article 128, assaults on noncommissioned officer, Article 134, drunk and disorderly, etc.
