Applicant’s Request

The application for discharge review, received 000410, requested that the characterization of service on the discharge be changed to honorable or general/under honorable conditions.
The applicant requested a personal appearance hearing discharge review. The applicant listed the American Legion as the representative on the DD Form 293.

Decision

A personal appearance hearing was conducted in Washington, D.C. on 010514. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: NAVMILPERSMAN, Article 3630600.

940309:  An Administrative Discharge Board, based upon a preponderance of the evidence and by unanimous vote, found that the applicant had committed a serious offense, that the misconduct warranted separation, and recommended discharge under other than honorable conditions.

PART III – RATIONALE FOR DECISION AND PERTINENT
REGULATION/LAW

Discussion

The applicant was discharged on 940414 under other than honorable conditions for misconduct due to commission of a serious offense (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

The applicant’s representative submitted the following as issue 1: (Equity Issue) As evidenced by his supporting documentation, this former member opines that his post-service conduct has been sufficiently creditable to warrant the Board’s clemency relief as authorized under provisions of SECNAVINST 5420.174C, enclosure (1), paragraph 9.3.
The Navy Discharge Review Board is empowered to change the discharge only if equitable relief is determined to be appropriate. Equitable relief is an instance of leniency to moderate the severity of the punishment imposed. The Board carefully reviewed the applicant’s military record and post-service accomplishments and found that equitable relief was not warranted. The Board determined that the applicant’s misconduct diminished the quality of his service below that meriting an upgrade to his characterization of service. Accordingly, the Board voted unanimously that the applicant’s characterization of service shall not change.

05 Mar 93 until 21 Jul 94, Article 3630600, SEPARATION OF ENLISTED PERSONNEL BY REASON OF MISCONDUCT – COMMISSION OF A SERIOUS OFFENSE.

B. Under the Manual for Courts-Martial, a punitive discharge is authorized for violation of the Uniform Code of Military Justice, Article 92, for dereliction in the performance of duty, if adjudged at a Special or General Court-Martial.
