Applicant’s Request

The application for discharge review, received 991104, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 000720. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL (UNDER HONORABLE CONDITIONS)/ALCOHOL REHABILITATION FAILURE, authority: MILPERSMAN, Article 1910-152 (formerly Article 3630550).

The NDRB did note an administrative error on the original DD Form 214. Block 25, Separation Authority should read: “1910-152” vice “3630550”. The original DD Form 214 should be corrected or reissued as appropriate.

Issues

1. I (applicant), am requesting to change my discharge of General Under Honorable Conditions to Honorable Conditions I feel my discharge was inequitable because it was based on an isolated incident. While in the United States Navy I had an alcohol related incident. I was told by the Navy to either go to a rehabilitation program or get out. I chose the later. I have not had any other incident related to alcohol. I have also joined the United States National Guard and feel Honorable Conditions would help with my future in the National Guard. Sincerely,

980323:  Applicant to Substance Abuse Rehabilitation Department from 23Mar98 to 24Apr99.

980402:  Applicant released from treatment for alcohol dependency based on applicant's request to terminate.

980429:  Applicant certified failure of treatment for alcohol dependency at Substance Abuse Rehabilitation Department, Naval Medial Center, San Diego, CA. Applicant further certified had failed said treatment due to my inability to cooperate and participate in an alcohol dependency treatment regimen.

980429:  Applicant notified of intended recommendation for discharge with general (under honorable conditions) by reason of convenience of the government as evidenced by Alcohol Rehabilitation failure due to your inability to participate in an alcohol dependency treatment regimen.

980429:  Applicant advised of his rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

980505:  Commanding officer directed discharge with general (under honorable conditions) by reason of alcohol abuse rehabilitation failure.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 980605 with a general (under honorable conditions) due to alcohol rehabilitation failure (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant’s issue that her discharge was inequitable because it was based on an isolated incident is without merit. The applicant was diagnosed as being alcohol dependant and voluntarily disenrolled from her treatment program. The NDRB found no impropriety in the applicants discharge. Relief not warranted.

The applicant provided no documentation to support her claim of sobriety, ie completion of aftercare program or documented sobriety. Further the applicant failed to provide documentation to support her claim that she is a member of the National Guard. The applicant has 15 years from date of discharge to appear in person along with proper post service documentation for consideration of an upgrade to honorable.
