Applicant’s Request

The application for discharge review, received 000523, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a personal appearance hearing discharge review before a traveling panel closest to San Diego, CA. The applicant did not list any representative on the DD Form 293. In the acknowledgement letter to the applicant, the applicant was informed that the Naval Discharge Review Board (NDRB) does not travel, all hearings are held in the Washington, DC Area. NDRB also advised that the board first conducts a documentary review prior to any personal appearance hearing.


Decision

A documentary discharge review was conducted in Washington, D.C. on 001201. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: MARCORSEPMAN Par. 6210.3.



PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

1. I would like the opportunity to have my re-enlistment code status upgraded. I would like the chance to serve my country in the manner to which I know I can, I know that I could be someone that is trustworthy, dependable and capable to do the duties in which are expected of me. So therefore I would like to request the upgrading of my re-enlistment code and my under other than honorable conditions discharge. Thank you for your time and understanding. Also another issue that I would like to share is that, I am currently married with 3 kids. I feel that I am ready for all responsibility that is required with such a position. I feel I was treated very unfairly at the time of my administration separation. I was not assisted properly in trying to explain my side of what happened in doing this request I am hoping to have the opportunity to explain my actions and what the problem that I feel was overlooked. I felt very strongly that it had a lot to do with racism, but was not given the chance to tell my side. My lawyer told me to do things his way, but given the opportunity again, I would make sure everything is said and nothing left out. I have adequate proof to back up the charges that were against me in which led up to my discharge. Once again Thank you for your time and patience.

980626:  Counseled for deficiencies in performance and conduct. 990723:  NJP for violation of UCMJ, Article 86: UA, on or about 990712, SNM was 15 minutes late to his Domestic Abuse Intervention Program Class, violation of UCMJ Article 86: UA, on or about 990714, SNM was 10 minutes late to his Domestic Abuse Intervention Program Class.

         Award: Forfeiture of $479.00 per month for 2 months (suspended for 60 days), restriction for 10 days, extra duty for 25 days, reduction to E-1. Not appealed.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 990929 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

Concerning a change in reenlistment code, ( issue 1), the NDRB has no authority to change reenlistment codes or make recommendations to permit reentry into the naval service or any other of the Armed Forces. The NDRB has no jurisdiction over reenlistment, reentry, or reinstatement into the Marine Corps. Reenlistment policy of the naval service is promulgated by the Commandant, United States Marine Corps, Code MMEA, 3280 Russell Road, Quantico, VA 22134. Neither a less than fully honorable discharge nor an unfavorable "RE" code is, in itself, a bar to reenlistment. A request for a waiver is normally done only during the processing of a formal application for enlistment through a recruiter. Relief denied.

The applicant believes that he was treated unfairly and that racism had a lot to do with his discharge. The Board found nothing in his records, nor did the applicant provide any documentation, to substantiate these allegations. The Board did find that the applicant provided a letter requesting permission to remain in the Marine Corps where he stated that he could “not blame anyone but myself” for his behavior. This statement is in complete opposition to his comments in issue 1. Relief denied.

The applicant is reminded that he is eligible for personal appearance hearing within 15 years from the date of his discharge. Post-service conduct can be considered. Documentation is required.

A. Paragraph 6210, MISCONDUCT , of the Marine Corps Separation and Retirement Manual, (MCO P1900.16E), effective 18 Aug 95 until Present.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ.
