Applicant’s Request

The application for discharge review, received 000614, requested that the characterization of service on the discharge be changed to general/under honorable conditions and the reason for the discharge be changed to general. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 010201. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Misconduct-Pattern of misconduct (administrative discharge board required but waived), authority: MARCORSEPMAN Par. 6210.3.

Issues

1. I feel that my discharge was inequitable because it was based on one group of mistakes I had on my bank account. I was over seas when it happened when I returned to the states it was handled by myself and Lt. A_ C_ who was to make sure all matters was taken care of and played in full before my BTRY, office hours. We doubled check and all were taken care of!! Then while on duty in "Desert Storm" one last floating checks showed up from about 4-5 months prior, which occurred during the same group of bounced checks I had the 1 st office hours, so in this matter I got a second office hours and which the wanted me discharged. In only has 2 1/2 - 3 weeks to go before my E.A.S. in which I would have got a General Discharge.

920103:  Applicant advised of his rights and having consulted with counsel certified under UCMJ Article 27B, elected to appear before an Administrative Discharge Board.

920103:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to a pattern of misconduct. The factual basis for this recommendation was three nonjudicial punishments.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 920415 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant indicates that his one group of mistakes occurred when he was overseas and that his second NJP was for a bounced check that he should have been punished for during his first NJP. The Board disagrees. The Board found that during the applicant’s enlistment he received 6 counseling entries for various offenses punishable under the UCMJ, including: 2 for losing his ID card; 1 for loss of his meal card; 1 for financial irresponsibility; 1 for UA and 1 for misconduct. In addition the applicant had 3 NJP’s, not 2 as he indicated. All three were for writing bad checks totally almost $3000 of indebtedness. One of the three also included a UA charge and disobeying a lawful order. Clearly the records show that he had a pattern of misconduct. The command worked with the applicant, as the counseling entries indicate, however, he failed to take corrective action. Relief denied.

The Board does agree that the applicant was discharged 3 weeks prior to his EAS, although this is non-decisional. The applicant has provided no proof that the last NJP was for a bounced check that was covered in his first NJP. Relief denied.

The following is provided for the benefit of the applicant. Normally, to permit relief, an error or injustice must have existed during the period of enlistment in question. There is no law, or regulation, which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in civilian life, subsequent to leaving the service. However, the NDRB is authorized to consider outstanding post-service factors in the recharacterization of a discharge, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review. Verifiable proof of any post-service accomplishments must be provided in order for the applicant to claim post-service conduct and behavior as a reason to upgrade a less than Honorable discharge. The applicant is reminded that he is eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of his discharge. The applicant can provide additional documentation to support any claims of post-service accomplishments at that time. Representation at personal appearance hearing is highly recommended but not required.
