Applicant’s Request
The application for discharge review, received 990111, requested that the characterization of service on the discharge be changed to general/under honorable conditions. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 000201. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/Separation in lieu of trial by court martial, authority: NAVMILPERSMAN, Article 3630650.





PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Issues

 1. My mother was having considerable problems with my younger sister and brother. She was drinking (alcohol) to cope with the issues of raising children and dealing with a abusive husband (Stepfather) to me. I being her oldest son felt responsible to help her deal with the complete trauma. I had a difficult time emotionally in boot camp focusing on my training, but was able to complete boot camp successfully. When I got into the airman apprenticeship program I started going to the enlisted men's club and drinking heavily to relieve my stress. I tried to focus on my test and my training to no avail. I eventually left my apprenticeship program and returned home unauthorized. I latter returned knowing it was wrong to have gone (AWOL). Today I am sober since leaving U.S.N and thanks the U.S.N., for being understanding supportive during this extremly difficult time in my life.

850422:  Ordered to active duty for 36 months under the Active Mariner program.
850903:  Report of Declaration of Deserter (NAVPERS 1600-3). Applicant declared a deserter on 850902 having been an authorized absentee since 0700, 850802 from RTC NTC SAN DIEGO CA.

851021:  Report of Return of Deserter. Applicant surrendered and returned to military control as of 1300, 851015 by RTC NTC SAN DIEGO CA. Retained onboard for disciplinary action and disposition.

851022:  Charges preferred to special court-martial for violation of the Uniform Code of Military Justice (UCMJ) Article 86:
         Unauthorized absence from 850802 until 851015.

851028:  A pplicant requested an administrative discharge under other than honorable conditions in lieu of a trial by court-martial. He consulted with counsel and was fully advised of the implications of his request. The applicant stated he understood the elements of the offense(s) with which he was charged, and admitted he was guilty of all the charges preferred against him. Specifically, he admitted to violating UCMJ, Article 86: UA from 850802 until 851015. The applicant stated he was completely satisfied with the counsel he had received. The applicant understood that if discharged under other than honorable conditions, it might deprive him of virtually all veterans' benefits based upon his current enlistment, and that he might expect to encounter substantial prejudice in civilian life in situations wherein the type of service rendered or the character of discharge received therefrom may have a bearing
851121:  Commanding Officer, Recruit Training Command, San Diego, exercising GCMCA, approved the request for an administrative separation in lieu of a trial by court-martial, and directed applicant’s discharge.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 851204 under other than honorable conditions in lieu of a trial by court-martial (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E)
In the applicant’s issue, the Board sympathized with the applicant’s plight, however determined that his discharge was proper and equitable. The Board found nothing in the records nor did the applicant submit any supporting documentation that showed his personal problems were of sufficient magnitude that they could not be resolved through standard military channels or by the applicant’s chain of command. Furthermore, t o permit relief, an error or injustice must be found to have existed during the period of enlistment under review. There was nothing in the records, nor did the applicant provide any documentation, to indicate there existed an error of fact, law, procedure, or discretion at the time of discharge. There was no rights violation and no basis for relief.

The following is provided for the applicant’s edification. The NDRB is authorized to consider post-service factors in the recharacterization of a discharge. The applicant must be aware that there is no law or regulation which provides that an unfavorable discharge may be upgraded based solely on the passage of time, or good conduct in the civilian life subsequent to leaving the service. Normally, to permit relief, an error or injustice must have been found to have existed during the period of enlistment in question. Outstanding post-service conduct, to the extent that such matters provide a basis for a more thorough understanding of the applicant’s performance and conduct during the period of service under review, may be considered by the NDRB. The applicant is reminded that he is eligible for a personal appearance hearing provided the application is received within 15 years from the date of discharge. Representation at personal appearance hearing is highly recommended.

B. A punitive bad conduct discharge may be adjudged for violation of the Uniform Code of Military Justice, Article 86, unauthorized absence for a period more than 30 days, upon conviction by a Special or General Court-Martial, in accordance with the Manual for Courts-Martial.
