Applicant’s Request

The application for discharge review, received 981118, requested that the characterization of service on the discharge be changed to honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 991012. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned an inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall change. The discharge shall change to: GENERAL (UNDER HONORABLE CONDITIONS)/ PATTERN OF MISCONDUCT, authority: NAVMILPERSMAN, Article 3630600.

1. I was in the middle of a divorce from the first day I reported for duty in the U.S and the Frank Cable. I had _____ issues that resulted in my discharge. I would like to have my discharge changed for my personal benefit, I was young and just wanted out. When I was active duty I did my job well all the way up to my last day. I was active in OPPR Drills and other Div activities. Please review my service record and consider my request.

920915:  Civil conviction at N. Charleston Municipal Court for driving with no license, license under suspension in another state, S.C. Code 51-1-460.

930329:  Civil conviction at N. Charleston Municipal Court for DUS, S.C. Code 56-1-460; and failed to yield right of way, S.C. Code 56-5-2334.

930625:  BUPERS directed the applicant's discharge under other than honorable conditions by reason of misconduct due to a pattern of misconduct.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 930708 under other than honorable conditions for misconduct due to a pattern of misconduct (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper but inequitable (C and D).

Although the applicant was properly discharged, the NDRB found the characterization of discharge, other than honorable, inequitable. Weighing the applicant’s overall service against the relatively minor involvement with civil authorities, the NDRB voted unanimously to upgrade the applicant’s characterization of service. The NDRB did not, however, intend to entirely excuse the applicant’s actions with an upgrade to honorable and decided the applicant must be held accountable for his actions. Accordingly, the applicant’s shall be changed to: General/ Under Honorable Conditions.
