Applicant’s Request

The application for discharge review, received 981106, requested that the characterization of service on the discharge be changed to Honorable and the reason for the discharge be changed to Secretarial Authority. The applicant requested a documentary record discharge review. The applicant listed the Military Justice Clinic, Inc. as his representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 991004. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL (UNDER HONORABLE CONDITIONS)/ALCOHOL REHABILITATION FAILURE, authority: MILPERSMAN, Article 3630550.

Chronological Listing of Significant Service Events :

960107:  [Incorrect date on this document. The applicant was discharged 961104] Commanding officer discharged applicant with General (under Honorable conditions) by reason of alcohol abuse rehabilitation failure. Commanding officer’s comments (verbatim): SN (applicant) exhibited a lack of maturity and poor judgement. He was convicted for DUI which resulted in a Level III alcohol rehabilitation failure as outlined by reference (a). His pattern of behavior indicates that he has no regard for naval policy or regulations as evidenced by his alcohol involvement. SN (applicant) elected in the statement of awareness (enclosure (2)) to submit a statement on his behalf and failed to do so in the alloted time provided. SN (applicant) was separated from the Naval service with the characterization of a General discharge.

960909:  Medical Officer evaluation: Alcohol abuse. CAAC evaluation: A: Alcohol abuse, no evidence of dependence. P: Recommend Level III treatment for ETOH.

961002:  Applicant completed Level III program for alcoholism and briefed on the components of continuing are required.

961026:  Applicant arrested and charged with DUI (BAC 084%) and headlights - failed to dim when required. Place of trial: Duvall County courthouse, date unknown at present time.

961030:  Applicant notified of intended recommendation for discharge with General (under Honorable conditions) by reason of alcohol abuse rehabilitation failure.

961104:  Medical Screening: Physically qualified for separation due to Level III, CAAC failure.

961104:  Applicant advised of his rights and having consulted with counsel certified under UCMJ, Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation and to submit a statement.

970213:  USS DE WERT informed commands must process for all reasons for which the minimum criteria are met. Applicant should have been processed for misconduct due to commission of a serious offense and misconduct due to civil conviction for DUI.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 961104 with a General (under Honorable conditions), due to alcohol rehabilitation failure (A). The Board presumed regularity in the conduct of governmental affairs (B). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (C and D).

The applicant introduced no decisional issues for consideration by the Board.

Although not raised as an issue, the following information is provided for the applicant’s edification. In addition to the service record, the NDRB is authorized to consider post-service factors in the recharacterization of a discharge (E, Part IV). While it is true the applicant cannot go back and undo his prior mistakes, he does have the opportunity to contribute in a positive way to society and warrant clemency. Those contributions that would be looked upon favorably include educational pursuits, employment performance record, being a contributing member of society and making a positive impact in the community through volunteer work. The applicant must prove that his post-service conduct has been above reproach and he is making a valid attempt at making amends for the misconduct he committed during the period of service under review.

The 15 year window, during which time applicants may appeal their discharge, was established to allow time for establishing oneself in the community and for making these substantial, documented life style changes and community contributions. The applicant is reminded that he remains eligible for a personal appearance hearing, provided an application is received within 15 years from the date of discharge.
