Applicant’s Request

The application for discharge review, received 990126, requested that the characterization of service on the discharge be changed to Honorable. The applicant requested a documentary record discharge review. The applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 991206. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, NDRB discerned no impropriety or inequity in the characterization of the applicant’s service. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: BAD CONDUCT DISCHARGE/As a result of a courts-martial (SPCM) – Other, authority: MARCORSEPMAN Par. 1105.

1. I R____ S_____ believe or think that my discharge should be upgraded to honorable or something other than a bad conduct discharge. I think I didn't do anything wrong to be kicked out like that. It has really held me down ever since. I spent 23 months in the U.S.M.C, and did a very good job, and made it very well. I thought that for people like me should be able to see something from their work and decent military service and record. Because of it, I have no benefits for what I would like to do, its like I'm no a veteran at all, and I should be. I would like to get on with my life somehow. If I had an honorable discharge I would do what ever I could to preserve it. My discharge may have been unjust.

PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The applicant was discharged on 900722 with a bad conduct discharge which was the sentence adjudged by a properly constituted special court martial that was determined to be legal and proper, affirmed in the legal chain of review and executed (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

In the applicant’s issue 1, the Board determined this issue has no merit. The applicant claims he didn’t do anything wrong, his discharge has held him back and he has no benefits. The applicant was found guilty, at Special Court-Martial, of disrespect, disrespectful language, possessing machine gun live tracer rounds in his BEQ room, wrongful possession of martial arts weapons, wrongful possession of two AFID cards, wrongful possession of drug paraphernalia, two specifications of illegal drug use and drunk and disorderly. It is true that a Bad Conduct discharge will effect your options in the civilian world and you are not entitled to military benefits. The applicant has not provided the Board with any documented evidence to show that he has become a credible citizen, living a life worthy of clemency and upgrade to his discharge. Relief denied.

A. Paragraph 1105, DISCHARGE ADJUDGED BY SENTENCE OF COURTS-MARTIAL , of the Marine Corps Separation and Retirement Manual, (MCO P1900.16D), effective 27 Jun 89 until 17 Aug 95.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article [ e.g., Article 86, unauthorized absence for more than 30 days].
