This is in reply to your letter of 7 October 2008 in which you
request, under the provisions of the Freedom of Information
Action and the Privacy Act copies of all of the documents
requested or considered by the Board in its review of your case.

You are specifically asking whether or not the Board obtained
investigations conducted by the Naval Criminal Investigative
Service, the Navy Inspector General, the Federal Bureau of

Investigation and documents that you allege are held by several
other commands and government agencies.

Please by advised that the only documentation considered or
obtained by the Board was your Application for Correction of
Military Records (DD Form 149) with its attachments, your
service record and a copy of your retirement point record which
was obtained from the Navy Personnel Command. At that time, the
Board was informed that you are receiving retired pay. A copy
of your retirement point record is enclosed.

As indicated in the Board's letter of 28 July 2008 there is
nothing in your service record regarding your allegations or
contentions. When your case was closed your service record was
returned to storage at the National Personal Record Center, St.
Louis, Missouri 63132. Once your record is returned to file,
you may obtain a copy by calling (314)592-1150, extension 4022.

The Board is not authorized to conduct investigations and the
burden of proof is on the applicant to show that an error or
injustice occurred. Further, the Board is only authorized to
correct individual service records of the Navy and Marine Corps.
A correction to other records of the Department of the Navy and
other government agencies is not authorized. A copy of the
Board's regulations is enclosed.
Therefore it appears that there is no further action that can be
taken by the Board at this time.
