This is in reference to your application for correction of your
naval record pursuant to the provisions of title 10 of the United
States Code, section 1552.

A three-member panel of the Board for Correction of Naval
Records, sitting in executive session, considered your
application on 7 October 2008. Your allegations of error and
injustice were reviewed in accordance with administrative
regulations and procedures applicable to the proceedings of this
Board. Documentary material considered by the Board consisted of
your application, together with all material submitted in support
thereof, your naval record and applicable statutes, regulations
and policies.

In addition, the Board considered an advisory opinion furnished
by Headquarters Marine Corps, a copy of which is enclosed, and
your rebuttal thereto dated 29 July 2008. I am also enclosing
your current Career Retirement Credit Report which shows that you
have been credited with 6992 retirement points and that as of 24
September 2008 you have 26 years of qualifying service.

After careful and conscientious consideration of the entire
record, the Board found that the evidence submitted was
insufficient to establish the existence of probable material
error or injustice. In this connection the Board substantially
concurred with the comments contained in the advisory opinion.

Accordingly, your application has been denied. The names and
votes of the members of the panel will be furnished upon request.

It is regretted that the circumstances of your case are such that
favorable action cannot be taken. You are entitled to have the
Board reconsider its decision upon submission of new and material
evidence or other matter not previously considered by the Board.
In this regard, it is important to keep in mind that a
presumption of regularity attaches to all official records.
Consequently, when applying for a correction of an official naval
record, the burden is on the applicant to demonstrate the
existence of probable material error or injustice.

a. Reference (a) requests an advisory opinion on Meas petition

to return her anniversary date to its previous year prior to the completion
of an audit of her Career Retirement Credit Report performed by this
Headquarters. As shown in enclosure (1), two qualifying years of service
towards retirement became non-qualifying due to the shift in the anniversary
date due to the dates of the duty performed, and the associated retirement

points, now falling in different anniversary years.

performed is properly credited to the anniversary year in which the service
was performed as required by reference (b). Qualifying service is used to
determine a member's initial eligibility for a reserve retirement with pay
(when the member completes 20 qualifying years of service) and then is used
to determine if a member has satisfied time in grade requirements. As shown
in enclosure (2) iA ©: completed 25 years of qualifying service
and is eligible for a Reserve Retirement with Pay. She was promoted to her
current grade on 1 May 2004 and on 1 May 2007 completed 3 qualifying years in

grade as 3 egies. Reserve retired pay is based on the total retirement
points credited, to include retirement points earned in a non-qualifying

year. Enclosure (1) shows that once the audit 21 AT record
was completed, her total retirement points credited increased from 6869 to
6930.

1. As requested by the reference, we have audited your Career Retirement
Credit Record (CRCR), enclosure (1), in order to establish your correct Armed
Forces Active Duty Base Date (AFADBD). Our review included all active

service documented by your record and your active and reserve Leave and
Earnings Statements for the period of 25 September 1978 through 31 March
2008. During this period, you performed 6,398 days of active service which

equates to 17 years, 6 months and 7 days of active duty service. We have
determined your AFADBD to be 24 September 1990.

2. Enclosure (2) contains your CRCR showing our corrections. Enclosure (3)
is your corrected CRCR. All corrections to the CRCR have been made in the
Marine Corps Total Force System (MCTFS) and your CRCR has been certified as
correct. These corrections resulted in the change to your AFADBD. Your unit
and the Manpower Information Systems Support Office (MISSO) are no longer
authorized to make corrections to your CRCR. Any further corrections to your
CRCR must be submitted with documentation to this Headquarters (MMSR-5).

3, Ensure your present command places a copy of this letter in your Official
Officer Qualification Record (OQR) attazhed to your CRCR.
