This is in reference to your application for correction of your naval record pursuant to the provisions of title 10 of the United States Code, section 1552.

A three-member panel of the Board for Correction of Naval Records, sitting in executive session, considered your application on 13 March 2007. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, your naval record and applicable statutes, regulations and policies. In addition, the Board considered the letter from the Navy Personnel Command, dated 24 May 2005, a copy of which is enclosed.

After careful and conscientious consideration of the entire record, the Board found that the evidence submitted was insufficient to establish the existence of probable material error or injustice. In this connection the Board substantially concurred with the comments contained in the letter from the Navy Personnel Command.

Accordingly, your application has been denied. The names and votes of the members of the panel will be furnished upon request.

It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new and material evidence or other matter not previously considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.

This is in response to your inquiry concerning your eligibility for retirement from the U. S. Navy. I conducted a thorough review of your service record in addition to the documents you provided me. I have concluded that you had nearly 21 years of service as of the date of your discharge on 8 December 1984. Your service included 3 years and 6 days with the U. S. Coast Guard; 2 years, 11 months and 9 days with the U. S. Anny Reserve; and 15 years with the U. S. Navy. This is a total of 20 years, 11 months and 15 days.

While you have nearly 21 years of military service, you only have about 13 years of qualifying years for retirement. A qualifying year must be at least 50 points at the end of your anniversary year. Therefo r e, you have about 7 years where you did not satisfy or meet the requirement of obtaining the 50 points each year.

In addition, I am enclosing a printout issued by the Naval Reserve Personnel Center, New Orleans that supports the information I have outlined in the above paragraphs. If you believe that you are eligible for retirement from the Navy, I suggest that you petition the Navy’s Board for Correction of Naval Records and have them review your record. I have enclosed a (DD Form 149) for your convenience. I am also returning your photograph and documents you provided me. I will be returning your service record to the National Personnel Records Center, St. Louis.
