1. Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show the orders that discharged Petitioner from active duty were issued prior to moving his household goods (HHG).

2. The Board, consisting of Mses. Gilbert, Wilcher, and Mr. Pfeiffer, reviewed Petitioner’s allegations of error and injustice on 13 March 2007 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, naval records, and applicable statutes, regulations and policies.

3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows:

a.       Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy.

b.       In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action.

CONCLUSION

Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action.

RECOMMENDATION:

That Petitioner’s naval record be corrected, where appropriate, to show that:

a.       Petitioner’s orders that discharged him from the U. S. Navy were issued 2 February 2006 vice any other date.

b.       The following information will be used to reimburse Petitioner for his move:

(1). Full name and SSN:

(2). Rank/rate held at time of discharge: HN, E-3.

(3). Petitioner discharged on: 28 February 2006.

(NOTE: Petitioner will re-submit his claim for reimbur se ment of total weight moved under the PPM program from Bethesda, Md to Lynchburg , OH. The claim package must include a copy of this letter, c y of weight tickets, and a completed DD Form 1351-2. If weight tickets are not available, Petitioner should contact the HHG auditors a 1-888-742-4467 for guidance. The entire package should be mailed o Business Support Department, HHG Audit Team Code 302, FISC Norfolk , VA 23411-3392. The auditors will calculate the member’s reimbur se ment per JFTR U5320-D2 based on total weight moved not to exceed PCS we ight allowance. The Petitioner will retain a copy of every do cument mailed to Norfolk, VA.)
