1.       Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner was entitled to travel of dependents and shipment of household goods (HHG) when he was sent on 560 days Temporary Additional Duty.

2.       The Board, consisting of Messrs. Lucas, Mann, and Storz, reviewed Petitioner’s allegations of error and injustice on 7 August 2007 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, naval records, and applicable statutes, regulations and policies.

3.       The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows:

a.       Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy.

b.       In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action.

CONCLUSION

Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action.

RECOMMENDATION:

That Petitioner’s naval record be corrected, where appropriate, to show that:

a.       On 9 January 2006 BuPers modified the orders to include Petitioner was being sent on “Individual Augumentee Temporary Additional Orders (IATDY) for a period of 560 days TDY”. Travel of dependents and shipment of HHG at government expense were authorized and also included in the modification to the orders.

b.       Additional cost will be charged to FY06 BCNR funds which are 1761804 12TL 420 00013 H 068892 2D 6DV 000136DENVRX N68892 N00013O6MPDENVR.

(NOTE: Petitioner must submit his claim for reimbursement of HHG total weight moved under the personally procured move (PPM) program from Waldorf, MD to Dallas, PA. The claim package must include a copy of this letter, invoices, and copies of weight tickets for HHG shipped, a copy of his IATDY orders and a completed DD1351-2. The auditors will calculate reimbursement per the Joint Federal Travel Regulations (JFTR) paragraph U5320-D2 based on total weight moved not to exceed the weight allowance authorized in JFTR U4755 for HHG purposes.)

c.       A copy of this Report of Proceedings will be filed in Petitioner’s naval record.

4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true complete record of the Board’s proceedings in the above entitled matter.
