1. Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show the orders issued by CONNAVPERSCOM extending Petitioner’s duty in Djibouti were issued in January 2006.

2. The Board, consisting of Mses. Gilbert, Humberd, and Mr. Dietrich, reviewed Petitioner’s allegations of error and injustice on 6 February 2007 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, naval records, and applicable statutes, regulations and policies.

3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows:

a.       Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy.

b.       In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action.

CONCLUSION

Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action.

RECOMMENDAT ION:

That Petitioner’s naval record be corrected, where appropriate, to show that:

a.       COMNAVPERSCOM Millington TN issued the orders extending Petitioner’s tour of duty in Djibouti on “11 January 2006” vice “14 November 2006”.

b.       On 12 January 2006 Petitioner executed the appropriate documents whereby he voluntarily elected to participate in the DITY Program to move his HHG: that by endorsement dated 11 January 2006 authority for him to participate in the DITY Program was granted by the appropriate authorities and the proper documents were prepared to show that government procured equipment for the DITY move was obtained through the appropriate naval authorities and used by the Petitioner vice that he personally obtained and used rental equipment and/or his personal vehicle.

c.       The auditors will calculate the member’s reimbursement per JFTR U5320-D2 for all allowable charges, based on total weight moved, not to exceed the Government constructed cost for the member’s maximum weight allowance.

(NOTE: A copy of all documents pertaining to moving the household goods and a copy of this letter will be mailed to Business Support Department, HHG Audit Team, Code 302, FISC, Norfolk, VA 23511-3392.)

d.       A copy of this Report of Proceedings will be filed in Petitioner’s naval record.

4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true complete record of the Board’s proceedings in the above entitled matter.

5.
