I .   Pursuant  to  tlie  provisions  of  reference  (a), Sirl~ject hereinafter  referred  to as  Petitioner, 
filed  enclosure ( 1 )   with  this  Hoard  requesting,  in  effect,  tliat  tlie  applicable  naval  record  be 
corrected  to  show  pro~noted whet1  l'irst  eligible. 

2.  Tlie  Board,  consisting  of'  Messrs.  Reckctt,  Dunn,  and  f'feiffer,  reviewed  Petitioner's 
allegations of  error  and  ili~ji~stice on  7  May  2002  and,  pursirant  to  i t 5   regillations,  determined 
tliat  the  corrective action  indicated  helow  slioultl  he  taken  on  the available evidence of  record. 
Documentary  tilaterial considered  h y  tlie  Board  consisted  of  tlie  enclosures.  naval  records, and 
applicable  statutes,  regulations and  policies. 

3.  Tlie  Board,  having  reviewed  all  tlie  facts of  record  pertaining  to  F'eti  timer's allegations 
of  error  and  injustice,  finds as  follows: 

a.  Before  applying  to  this  Board,  Petitioner exhausted  all  ad~iiinistrative remedies 

available  ilrider existing  law  and  rcr1:lations within  the  nclpnrtment  o f  the  Navy.

In  correspondence  attached  as enclosure  (2), the  office  having  cognizance over  the 

sut>ject matter  addressed  in  Petitiowr's application  has  commented  to  tlie effect  tliat  the 
request  has  merit  and  warrants  favorable action. 

CONCLUSION 

Upon  review  and  consideration  of  all  tlie  evidence  of  record,  arid  especially  in  light  of  tlie 
contents of  enclosure  (2), tlie  Board  finds  the existence of  an  inillstice  warranting  the 
following corrective action.

That  Petitioner's naval  record  he  corrected.  where  appropriate.  to  show  that:

b.  That  a  copy  of  this  Kcport  ot' f'roceedings  he  filed  in  I'etitioner's  naval  record. 

4.  Pursuant  to  Section  6(c) ot' the  revised  F'rocedures  of  the  Board  for  Correction  of  Naval
