Issues: The applicant states "I was in bct when 9/11 hit. I have applied for a post 9/11 bill and I am currently enrolled in virginia college online in the medical office administration/assistant field. In order to get assistants from this bill I have to recieve and upgrade my discharge to honorable. I have explain the reason for the misconduct on my form. I unfortunately got a d.u.i while in service and got charged by a civilian court. Shortly after I became pregnant with my first child and therfore got a general. I enjoyed my m.o.s. and regret making decisions that affected my career and my civilian life. Please consider my upgrade, it will give me a chance to work on our army base at the hospital to give back to my fellow soldiers here in Georgia. Thank you for your time. Hooah."

VI. Facts, Circumstances, and Legal Basis for Separation
a. Facts and Circumstances:
The applicants record is void of the specific facts and circumstances concerning the events which led to the discharge from the Army. However, the record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicants signature.
The DD Form 214 indicates the applicant was discharged under the provisions of Chapter 14, AR 635-200, paragraph 14-12b by reason of a pattern of misconduct, with a characterization of service of general, under honorable conditions.

Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate; however, a general, under honorable conditions or an honorable discharge may be granted.
c. Response to Issues, Recommendation and Rationale:
After a careful review of all the applicants available military records and the issue submitted with the application, the analyst found no mitigating factors that would merit an upgrade of the applicants discharge.

Further, eligibility for veteran's benefits to include educational benefits under the Post-9/11 or Montgomery GI Bill does not fall within the purview of the Army Discharge Review Board. Accordingly, the applicant should continue to contact a local office of the Department of Veterans Affairs for further assistance.
Therefore, based on the available evidence, the analyst presumes government regularity in the discharge process and determined that the reason for discharge and the characterization of service were both proper and equitable and recommends to the Board to deny relief.
