                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 30 July 2004, the applicant was
diagnosed with an adjustment disorder with anxious mood and a depressive
disorder, not otherwise specified and recommended for discharge.  On 13
August 2004, the unit commander notified the applicant of initiation of
separation action under the provisions of Chapter 5-17, AR 635-200, by
reason of other designated physical or mental condition, with a general,
under honorable conditions discharge.  She was advised of her rights.  The
applicant waived her right to consult with legal counsel, was advised of
the impact of the discharge action, and did not submit a statement in her
own behalf.  The unit commander subsequently recommended separation from
the service.  The intermediate commander reviewed the proposed discharge
action and recommended approval of the separation action with a general,
under honorable conditions discharge.  On undated, the separation authority
directed that the applicant be discharged with a characterization of
service of general, under honorable conditions.

      b.  On 8 August 2004, the applicant was discharged.  At the time of
discharge, the applicant had completed 9 months and 26 days of active
military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
provides the basic authority for the separation of enlisted personnel.
Paragraph 5-17 provides that a soldier may be separated for other physical
or mental conditions not amounting to a disability under Army Regulation
635-40, that interferes with assignment to or performance of duty.  The
regulation requires that the condition interferes with the soldiers’
ability to perform duty, and requires that the diagnosis be so severe that
the soldier’s ability to function in the military environment is
significantly impaired.  Army policy states that the service of personnel
separated under this paragraph will be characterized as honorable, general,
under honorable conditions, or uncharacterized if in entry-level status.
However, a characterization of service less than honorable is normally
inappropriate for this type of discharge.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The evidence of record shows that the
applicant was discharged under the provisions of Chapter 5, Paragraph 5-17,
AR 635-200 by reason of other designated physical or mental condition, with
a characterization of service of general, under honorable conditions.  An
honorable characterization of service is usually appropriate for
individuals separated under the conditions enumerated in this chapter
absent serious misconduct.  Given the nature of the applicant’s infractions
and the circumstances surrounding her discharge, the Board determined that
the characterization of service was too harsh.  Accordingly, the Board
voted to grant relief in the form of an upgrade of characterization of
service to fully honorable.  The Board determined that the reason for
discharge was both proper and equitable, and voted not to change it.
However, the Board noted an administrative error in the applicant’s RE code
and directed an administrative correction to Block 27 (Reentry Code) of the
applicant’s DD Form 214.
