The Army Discharge Review Board reviewed your case and determined

Form 172, Case Report and Directive. This document reflects the findings,
conclusions, and reasons for the Board's decision. The official
notification of any change to your official military personnel record,

Support Division.
If you believe that the decision in your case is unclear, not
responsive to the issues raised, or does not otherwise agree with the
decisional document requirements of DoD Directive 1332.28, you may submit a

read Enclosure 5 of that directive before submitting a complaint. The
complaint procedure does not permit you to challenge the merits of the
decision, but is designed solely to ensure that the decisional document
meets applicable requirements for clarity and responsiveness. You may

You may reapply to the Army Discharge Review Board for a personal

PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 12 September 2000, DA, 9th
Personnel Service Company, Fort Lewis, WA, Orders 88-2 discharged the
applicant from the Regular Army, effective 20 May 1992. The record
contains a properly constituted DD Form 214 (Certificate of Release or
Discharge from Active Duty) which was authenticated by the applicant. His
DD Form 214 indicates that he was discharged under the provisions of
Chapter 10, AR 635-200 by reason of for the good of the service-in lieu of
trial by court-martial, with a characterization of service of under other
than honorable conditions. The specific facts and circumstances pertaining
to the applicant’s discharge are not contained in the available records.
b. On 20 May 1992, the applicant was discharged. At the time of
discharge, the applicant had completed 3 years, 8 months, and 19 days of
active military service in the period under review.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt. Army policy states
that although an honorable or general discharge is authorized, a discharge
UOHC is normally considered appropriate.

While all the facts and circumstances surrounding the applicant’s discharge
are not contained in the record, the Board noted that the applicant had
service of sufficient length and merit to warrant an upgrade of the
discharge being reviewed. Accordingly, the Board voted to grant partial
relief in the form of an upgrade of characterization of service to general,
under honorable conditions. In the absence of evidence to the contrary,
the Board presumed regularity in the reason for discharge and voted not to
change it.
