                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The specific facts and circumstances pertaining to the
applicant’s discharge are not contained in the available records.  The
record contains a properly constituted DD Form 214 (Certificate of Release
or Discharge from Active Duty) which was authenticated by the applicant.
His DD Form 214 indicates that he was discharged under the provisions of
Chapter 7, AR 635-200 by reason of defective enlistment agreement, with a
general, under honorable conditions discharge.

      b.  On 31 December 2003, the applicant was discharged.  At the time
of discharge, the applicant had completed 1 year, 7 months, and 11 days of
active military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 7, paragraph 7-16, of that regulation provides, in pertinent part,
that a defective enlistment agreement exists when the soldier is eligible
for enlistment in the Army but does not meet the prerequisites for the
option for which enlisted.  Soldiers separated under this chapter may be
awarded an honorable discharge, or a general discharge, or a discharge
under other than honorable conditions.  If in an entry level status the
characterization will be uncharacterized.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 The evidence of record shows that the applicant was separated under the
provisions of Chapter 7, AR 635-200, by reason of defective enlistment
contract with a characterization of service of general, under honorable
conditions.  The Board noted that the applicant served for nearly two
years, attained the grade of specialist/E-4, and did not have any
infractions of discipline.  Given the above, the Board determined that the
characterization of service is inequitable.  Accordingly, the Board voted
to grant full relief in the form of an upgrade of characterization of
service to fully honorable.  The Board found that the reason for discharge
was both proper and equitable, and voted not to change it.
