      The Army Discharge Review Board reviewed your case and determined

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The official record is void of the specific facts and
circumstances pertaining to the applicant’s discharge from the Army.  The
evidence available for the Board’s review was submitted by the applicant.
She submitted the following:  The unit commander’s notification of
initiation of separation action under the provisions of Chapter l4, AR 635-
200, by reason of misconduct—patterns of misconduct, with a general, under
honorable conditions discharge; her election of rights indicating that she
waived her right to consult with legal counsel and to appear before an
administrative separation board; the intermediate commanders recommendation
of approval of the separation action with a general, under honorable
conditions discharge; and, the separation authority’s approval of the
separation with a general, under honorable conditions.  The applicant also
submitted copies of her counseling statements, Article 15 action, and a
memorandum of reprimand.  This documentation shows that the applicant was
recommended for discharge because she disobeyed lawful orders; was
disrespectful to officers; was drunk on duty while in a region of active
hostilities carrying a loaded weapon; wrongfully consumed alcohol in
Bagdad; and became pregnant by an individual not her husband.  The record
also contains a properly constituted DD Form 214 (Certificate of Release or
Discharge from Active Duty) which was authenticated by the applicant.  Her
DD Form 214 indicates that she was discharged under the provisions of
Chapter 14, AR 635-200 by reason of for the good of misconduct, with a
characterization of service of general, under honorable conditions.

      b.  On 7 August 2004, the applicant was discharged.  At the time of
discharge, the applicant had completed 1 year, 10 months, and 7 days of
active military service in the period under review.  Total time in service
could not be determined.

      c.  In the evidence submitted by the applicant are two letters of
support from two officers who knew the applicant during her last period of
active duty recommending that her characterization of service be changed to
honorable.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The Board does not condone the applicant’s
misconduct; however, determined that the characterization of service is too
harsh.  The applicant's misconduct was mitigated by service of sufficient
length and merit to warrant an upgrade of the discharge being reviewed.
Accordingly, the Board voted to grant relief in the form of an upgrade of
characterization of service to fully honorable.  The Board determined that
the reason for discharge was both proper and equitable and voted not to
change it.
