                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The evidence of record shows that the unit commander notified the
applicant of initiation of separation action under the provisions of AR 635-
200, Chapter 11, entry-level performance and conduct with an
uncharacterized discharge.  The reason for the proposed action was the
applicant’s personal issues that prevented him from conforming to the
military and serve honorably.  He was advised of his rights.  The applicant
waived his right to consult with legal counsel, was advised of the impact
of the discharge action, and did not submit a statement on his behalf.  The
unit commander subsequently recommended approval of the discharge action
and forwarded it through command channels to the separation authority.  The
intermediate commanders reviewed the proposed discharge action and
recommended approval with an uncharacterized discharge.  The separation
authority waived further rehabilitative efforts, and directed that the
applicant be released from active duty and transferred to the Individual
Ready Reserve to complete his statutory service obligation.  His service
was uncharacterized.

      b.  On 28 July 2000, the applicant was released from active duty.  At
the time of his release, the applicant had completed 5 months and 28 days
of active military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 11, of this regulation, in effect at the time, provided, for the
separation of personnel due to unsatisfactory performance, conduct, or
both, while in an entry level status.  This provision of regulation applied
to individuals who had demonstrated that they were not qualified for
retention because they could not adapt socially or emotionally to military
life, or because they lacked the aptitude, ability, motivation or self
discipline for military service, or that they had demonstrated
characteristics not compatible with satisfactory continued service.  The
separation policy applies to soldiers who cannot meet the minimum standards
prescribed for successful completion of training because of lack of
aptitude, ability, motivation or self-discipline.  The regulation requires
uncharacterized service for separation under this chapter.

        (2)  The issue is accepted.  Army regulations stipulate that entry-
level status and the uncharacterized description of service does not apply
to individuals once they complete initial entry training, are awarded an
MOS, and are assigned to a unit for duty.  In view of the foregoing, the
Board determined that the discharge was improper.  Accordingly, the Board
voted to grant full relief in the form of an upgrade of characterization of
service to fully honorable and a change to the narrative reason for
separation to Secretarial Authority.  This action entails a change in RE
code to 1.

      b.  Equity:      The parenthetical number(s) below correspond(s) to
