PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 29 September 1997, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—commission of a serious offense, with a general discharge (GD). He was advised of his rights. The applicant acknowledged notification, consulted with legal counsel, was advised of the impact of the discharge action, requested a hearing by board of officers and did not submit a statement on his behalf. The unit commander subsequently recommended separation from the Army. The intermediate commanders reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 14 April 1998, the board of officers met; the applicant appeared with legal counsel. The board recommended separation for misconduct-commission of a serious offense with a characterization of GD. On 3 August 1998, the separation authority directed that the applicant be discharged with a GD.

         b. On 14 August 1998, the applicant was discharged with a general, under honorable conditions discharge. At the time of discharge, the applicant had
2 years, 2 months, and 12 days service on his current enlistment and 17 years,
11 months and 21 days total time in service.

         c. The applicant tested positive for marijuana on 25 February 1997. He received an Article 15 for wrongful use of marijuana on 21 August 1997. On 14 April 1998, a Board of Officers recommended the applicant be separated under the provisions of AR 635-200, Chapter 14, with a General Discharge Certificate. The Board also recommended the applicant’s separation be suspended under the provisions of AR 635-200, paragraph 1-20, for six months. On 3 August 1998, the separation authority approved the Board of Officer’s recommendation of a general, under honorable conditions discharge. The separation authority did not approve the recommended suspension of the discharge.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

 (2) The issue is accepted. The Board carefully examined the applicant's record of service during the period of enlistment under review. There was a full consideration of his testimony before the Board of Officers, all faithful and honorable service, and the infraction of discipline which led to his separation from the Army. While the Board does not condone the applicant's misconduct, the Board determined that the misconduct was mitigated by the applicant’s length and quality of service and that the characterization of service was inequitable. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to fully honorable. However, the Board determined that the reason for discharge was proper and equitable and voted not to change it.
