                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The evidence of record shows that the applicant was charged with
wrongfully filing a fraudulent claim against the government in the amount
of $1000.00.  On 18 January 2001, the applicant consulted with legal
counsel and voluntarily requested, in writing, discharge under the
provisions of Chapter l0, AR 635-200 in lieu of trial by court-martial.  In
this request, the applicant admitted guilt to the offense, or a lesser
included offense.  Further, the applicant indicated that he understood that
he could receive an under other than honorable conditions discharge and
that the discharge would have a significant effect on eligibility for
veteran’s benefits.  The applicant submitted a statement in his own behalf.
 The unit commander and intermediate commanders recommended approval of a
general, under honorable conditions discharge.  On 1 February 2001, the
separation authority approved the discharge with a general, under honorable
conditions discharge.

      b.  On 1 March 2001, the applicant was discharged.  At the time of
discharge, the applicant had completed 3 years, 2 months, and 24 days of
active military service in the period under review and had a total of 13
years, 9 months and 10 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
under other than honorable conditions is normally considered appropriate.

2.  Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on
issues of propriety and/or equity:

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

      b.  Equity:      The parenthetical number(s) below correspond(s) to
                   the issue number(s) on the DD Form 293, or in Part VI,
                   Paragraph 1, above.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review
and heard his testimony.  There was a full consideration of all faithful
and honorable service as well as the infraction of discipline, the extent
thereof, and the seriousness of the offense.  While the Board does not
condone the applicant’s misconduct, it determined that the characterization
of service was inequitable.  The Board found that the length and quality of
the applicant’s service and the nature of the offense mitigated the
discrediting entry in the service record.  Accordingly, the Board voted to
grant partial relief in the form of an upgrade of characterization of
service to fully honorable.  However, the Board found that the reason for
discharge was both proper and equitable and voted not to change it.

        (1)  The issue is rejected.  The Board determined that the
applicant was appropriately assigned an RE code of 4, which indicates that
the applicant was separated from his last period of service with a
nonwaivable disqualifier and that he is ineligible for reenlistment.  See
response to issue 2 above.
