                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 14 January 2002, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l4, AR 635-200, by reason of
misconduct—commission of a serious offense, with an under other than
honorable conditions discharge.  He was advised of his rights.  The
applicant consulted with legal counsel, was advised of the impact of the
discharge action, and requested appearance before a board of officers.  The
intermediate commander reviewed the proposed discharge action, recommended
an under other than honorable conditions discharge, and forwarded the
proposed discharge for board action.  On 19 March 2002, board of officers
met; applicant appeared with counsel.  The board recommended separation
with a general, under honorable conditions discharge.  On 29 July 2002, the
separation authority approved the findings and recommendations of the
board, waived further rehabilitative efforts and directed that the
applicant be discharged with a characterization of service of general,
under honorable conditions.

      b.  On 2 August 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 2 years, 10 months, and 19 days of
active military service in the period under review and had a total of 11
years, 4 months and 10 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

Applicant and counsel issues:

        (1-9)  The issues are rejected.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The Board noted the applicant’s contentions;
however, his contentions relate to evidentiary and procedural matters which
were finally and conclusively adjudicated during his administrative
separation board, and furnish no basis for recharacterization of the
discharge.  The Board found that the discrediting entries in the
applicant's record were not outweighed by prior or subsequent service of
sufficient merit to warrant an upgrade of the discharge being reviewed.
The applicant's discharge was appropriate because the quality of his
service was not consistent with the Army's standards for acceptable
personal conduct and performance of duty by military personnel.  The Board
found no evidence of arbitrary or capricious actions by the command.  The
Board was satisfied that all requirements of law and regulation were met
and the rights of the applicant were fully protected throughout the
separation process.  The Board, being convinced that the reason for
discharge and the characterization of service were both proper and
equitable, voted to deny relief.
