                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 12 February 2002, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l4, AR 635-200, by reason of
misconduct—commission of a serious offense, with a general, under honorable
conditions discharge.  The unit commander indicated that he was initiating
separation proceedings based on the applicant’s wrongful use of cocaine.
She was advised of her rights.  The applicant consulted with legal counsel,
was advised of the impact of the discharge action, and requested appearance
before a board of officers.  The intermediate commander reviewed the
proposed discharge action, recommended a general discharge, and forwarded
the proposed discharge for board action.  On 2 April 2002, board of
officers met; applicant appeared with counsel.  The board recommended
separation with a general, under honorable conditions discharge based on
the applicant’s misconduct; however, the board further recommended
suspending the applicant’s discharge for a period of 6 months.  On undated,
the separation authority approved the Board’s findings of misconduct,
disapproved the Board’s recommendation regarding the suspension of the
discharge, and directed that the applicant be discharged with a
characterization of service of general, under honorable conditions.

      b.  On 17 July 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 3 years, 8 months, and 2 days of
active military service in the period under review and had a total of 23
years, 1 month and 20 days of active military service.  (Total time in
service does not necessary denote qualifying service years for retirement.)

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

      b.  Equity:      The parenthetical number(s) below correspond(s) to
                   the issue number(s) on the DD Form 293, or in Part VI,
                   Paragraph 1, above.

        (1)  The issue is rejected.  The Board found that the reason for
discharge was both proper and equitable, and voted not to change it.  The
Board noted the applicant’s contentions; however, her contentions relate to
evidentiary and procedural matters which should have been raised and
conclusively adjudicated at the time of her administrative separation
board, and furnish no basis for a change in the narrative reason for
discharge.  The evidence of record shows that the applicant had a positive
urinalysis for cocaine.  Her specimen was rescreened and again gave a
positive result; the presence of cocaine was then confirmed by gas
chromatography-mass spectrometry.  The administrative separation board
considered all the evidence presented by the applicant and her counsel, and
found that misconduct (use of illegal drugs) occurred and that she should
be separated with a general discharge.  The applicant’s request pertaining
to severance pay, cost of living increases, bonuses, retirement, etc., do
not fall within the purview of this Board.  If the applicant desires to
pursue these matters she should address them with the Army Board for
Correction of Military Records using the provided application.  See
response to issue (2), below.

        (2)  The issue is accepted.  The Board does not condone the
applicant’s misconduct; however, it determined that the characterization of
service is too harsh.  The applicant's misconduct was mitigated by service
of sufficient length and merit to warrant an upgrade of the discharge being
reviewed.  Accordingly, the Board voted to grant partial relief in the form
of an upgrade of characterization of service to fully honorable.
