                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 10 February 2000, the applicant
appeared before an Academic Review Board to determine if he should be
retained or dismissed from training.  The Board determined that the
applicant’s failure was due to low test scores and his desire to fail
because he no longer wanted to be in the U.S. Army and recommended that he
be discharged.  On 21 March 2000, the approval authority directed that the
applicant be processed for discharge.  On 5 April 2000, the unit commander
notified the applicant of initiation of separation action under the
provisions of Chapter l3, AR 635-200, by reason of unsatisfactory
performance, with a general, under honorable conditions discharge based on
the Academic Review Board’s determination.  He was advised of his rights.
On 5 April 2000, the applicant acknowledged receipt of his discharge
notification and waived his right to consult with legal counsel.  He did
not submit a statement in his own behalf.  The unit commander subsequently
recommended separation from the service and waiver of further
rehabilitative efforts.  On 7 April 2000, the proper legal authority
reviewed the separation action and found it to be legally sufficient for
further processing.  On 11 April 2000, the separation authority waived
further rehabilitative efforts and directed that the applicant be
discharged with a characterization of service of general, under honorable
conditions.

      b.  On 24 April 2000, the applicant was released from Active Duty for
Training, discharged from the Reserve of the Army, and returned to the Army
National Guard.  At the time of discharge, the applicant had completed 5
months and 29 days of active military service in the period under review
and had a total of 9 months and 6 days of total military service.

      c.  On 25 April 2000, the applicant was discharged from the Army
National Guard and as a Reserve of the Army under the provisions of
Paragraph 8-26d, NGR 600-200, by reason of unsatisfactory performance, with
a general, under honorable conditions discharge.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 13 contains the policy and outlines the procedures for separating
individuals for unsatisfactory performance, to include separation for those
individuals who fail to maintain Army physical standards.  Initiation of
separation proceedings is required for individuals without medical
limitations who have two consecutive failures of the Army physical fitness
test or who are eliminated for cause from Noncommissioned Officer Education
System courses unless the responsible commander chooses to impose a bar to
reenlistment per AR 601-280.  Service of individuals separated because of
unsatisfactory performance will be characterized as honorable or under
honorable conditions as warranted by their military records.

      a.  Propriety:   The parenthetical number(s) below correspond(s) to

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 The evidence of record shows that the applicant’s separation was initiated
and completed while the applicant was in an entry-level status (i.e., had
less than 180 days of continuous active duty service and had not been
awarded a military occupational specialty (MOS)).  Chapter 13, Paragraph 13-
1, AR 635-200, provides that soldiers in entry-level status are not to be
processed for separation under the provisions of Chapter 13.  In view of
the foregoing, the Board determined that the discharge was and is improper.
 Accordingly, the Board voted to grant full relief in the form of an
upgrade of characterization of service to fully honorable and a change to
the narrative reason for separation to Secretarial Authority.  This action
does not entail a change to the RE code.

     The Army Discharge Review Board, established under the provisions of
Section 30, Public Law 346, 78th Congress, 22 June 1944 and codified as
Title 10, United States Code, Section 1553, in the case of the applicant
named in Part I directs that the ARBA Support Division-St Louis issue a new
DD Form 2l4 to the applicant which reflects the following directed
change(s):
