PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Note: The evidence of record shows that on 3 February 1992, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 8, NGR 600-200, by reason of conviction by court, State of Kansas, with a general, under honorable conditions discharge. He was advised of his rights. The applicant declined legal counsel and a board of officers, was advised of the impact of the discharge action, and did not submit a statement in his behalf. The applicant did not signed NGB Form 22, indicating following facts: Character of service is a general, under honorable conditions discharge under the provisions of Chapter 8, NGR 600-200, for conviction by civil court.

         b. On 1 March 1992, the applicant was discharged with a general, under honorable conditions discharge, under the provisions of Chapter 8, NGR 600-200, by reason of conviction by civil court. He was credited with 10 years, and
11 days active service on the enlistment under review.

Legal/Regulatory Basis for Separation Action : National Guard Regulation (NGR) 600-200 and Army Regulation 135-178 govern procedures covering enlisted personnel management of the Army National Guard. Chapter 8 of NGR 600-200 covers, in pertinent part, reasons for discharge and separation of enlisted personnel from the State Army Reserve National Guard. Paragraph 8-26(p) of that regulation provides in pertinent part that individuals can be separated for being a conviction by civil court. Army Regulation 135-178 states that a member is a conviction by civil court.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above:

(1), (2), and (3) The issues are rejected. The Board carefully examined the applicant's record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as infraction of discipline, the extent thereof, and the seriousness of the offense. The conviction by civil authorities obligated military authorities to consider the applicant for discharge. Retention is normally only considered in exceptionally meritorious cases when clearly in the best interests of the Army. Because of the civilian conviction, the applicant diminished the quality of service below that meriting a fully honorable discharge. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that his service mitigated the misconduct. The Board concluded the applicant’s discharge was appropriate because the applicant’s misconduct was not consistent with the Army’s standards for acceptable personal conduct by military personnel. Accordingly, the Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
