PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 17 August 1990, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of conviction by a civil court. The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The unit commander subsequently recommended waiver of further rehabilitative efforts and recommended separation with an under other than honorable conditions (UOHC) discharge. The intermediate commanders reviewed the proposed discharge action and recommended approval of the separation action with a UOHC discharge. On 20 August 1990, after consulting counsel, the applicant unconditionally waived his right to an administrative separation board. The Staff Judge Advocate determined that the separation action was legally sufficient, and on 22 August 1990, the separation authority directed that the applicant be discharged with an UOHC discharge and that he be reduced to the grade of private/E-1.

         b. On 30 August 1990, the applicant was discharged with a UOHC. At the time of discharge, the applicant had completed 1 year, 4 months, and 1 day of his current enlistment, and a total of 5 years, 2 months and 9 days of credible service.

         c. The applicant’s record shows that he completed over 5 years of total service; attained the rank of sergeant/E-5; completed an overseas tour in Germany; and had earned an Army Achievement Medal and a Good Conduct Medal. The applicant’s disciplinary record documents only the incident which led to his discharge. The applicant was convicted of rape in the third degree, in the Pierce County Superior Court, Tacoma, Washington, on 16 July 1990. The unit commander processed the applicant for separation by reason of civil conviction and recommended that he receive a UOHC discharge.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1) The issue is rejected. The Board noted the applicant’s contention, as outlined in his statement to the Board, that, in effect, he did commit the offense, did not receive a fair trial, and if the Army had supported him he would not have had to get out. However, the conviction by civil authorities obligated military authorities to consider the applicant for discharge. Retention is normally only considered in exceptionally meritorious cases when clearly in the best interests of the Army. Because of the civilian conviction, the applicant diminished the quality of service below that meriting a fully honorable or general discharge. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that his service mitigated the misconduct. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
