PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 7 May 1997, the applicant was
found guilty by a Special Court-Martial of conspiracy to distribute cocaine
(861029) and wrongful distribution of cocaine (861029). She was sentenced
to a Bad Conduct Discharge, confinement for a period of three (3) months,
forfeiture of $400.00 per month for three (3) months, and reduction to
Private E1. On 7 May 1997 the applicant was placed in confinement at the
Installation Detention Facility, Fort Campbell, Kentucky. On 13 May 1997,
she was reassigned to the US Army Correctional Facility, Ft Riley, Kansas,
to serve the remainder of her confinement. On 21 July 1987, she was
released from confinement. On 24 July 1987, the applicant was placed on
involuntary excess leave pending the affirmation and execution of the Bad
Conduct Discharge. On 2 March 1988, the United States Army Court of
Military Review affirmed the findings of guilty and the sentence. The
portion of the sentence pertaining to the Bad Conduct Discharge was
affirmed by the Court of Military Review and duly executed.
b. On 12 October 1988, the applicant was discharged. At the time of
discharge, the applicant had completed 3 years, 1 month, and 15 days of
active military service (including 447 days of excess leave) and accrued 76
days of lost time in the period under review and had a total of 5 years, 1
month, and 6 days of total military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 3, Section IV, establishes policy and procedures for separating
members with a dishonorable or bad conduct discharge; and provides that a
soldier will be given a bad conduct discharge pursuant only to an approved
sentence of a general or special court-martial; and that the appellate
review must be completed and the affirmed sentence ordered duly executed.

(3) The issue is accepted. The Board carefully reviewed the
applicant’s military record and post service accomplishments and found that
clemency was warranted. Accordingly, the Board voted to upgrade the
applicant’s characterization of service to general, under honorable
conditions. A change in the reason for discharge is not authorized under
Federal statute.
(1) and (2) The issues are rejected. Individuals are assigned RE
codes based on their service records or the reason for discharge. The
applicant was appropriately assigned an RE code of 4, which indicates that
she was separated from her last period of service with a disqualification
