PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 6 March 1989, a special court-martial board found the applicant guilty of the wrongful distribution of 1.01 grams of cocaine (890111). She was sentenced to be discharged with a bad conduct discharge;to be confined for three (3) months; to forfeit $425.00 pay per month for three (3) months; and to be reduced to E-1. On 28 March 1989, the sentence was approved. On 10 January 1990, the sentence having been affirmed, pursuant to Article 71(c) having been complied with, the bad conduct portion of the sentence was ordered to be executed.

         b. On 12 March 1990, the applicant was discharged with a bad conduct discharge. At the time of her discharge the applicant had completed 2 years,
9 months, and 6 days of active service and had accrued 87 days of time lost due to confinement.

         c. The applicant’s record shows that she completed almost 3 years of service and attained the rank of specialist/E-4. There are no documented acts of valor, significant achievement, or service warranting special recognition contained in the record. There is also no disciplinary history recorded prior to the incident which led to her discharge. The applicant was found guilty by special court-martial of the wrongful distribution of cocaine. Her sentence included a bad conduct discharge which was duly executed upon completion of the appellate process.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 3, Section IV, establishes policy and procedures for separating members with a dishonorable or bad conduct discharge; and provides that a soldier will be given a bad conduct discharge pursuant only to an approved sentence of a general or special court-martial; and that the appellate review must be completed and the affirmed sentence ordered duly executed.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.


         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board noted the applicant’s contention that she should receive a medical pension and be granted an honorable discharge. The evidence of record clearly shows that the applicant was adjudged guilty by court-martial and that the sentence was approved by the convening authority. Court-martial convictions stand as adjudged or modified by appeal through the judicial process. The ADRB is empowered to change the discharge only if clemency is determined to be appropriate. Clemency is an act of mercy, or instance of leniency, to moderate the severity of the punishment imposed. After a thorough review of the applicant’s record and any issues submitted, the Board found no cause for clemency and therefore voted to deny relief.
