                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 7 February 2001, the applicant
was notified that his urine specimen collected on 17 January 2001 tested
positive for marijuana.  He refused to accept an Article 15 for wrongful
use of marijuana and demanded trial by court-martial.  On 7 December 2001,
the applicant was charged with wrongful use of marijuana.  This charge was
further referred to the Special Court-Martial Empowered to Adjudge a Bad
Conduct Discharge convened by Court-Martial Convening Order Number 15,
dated 17 September 2001.  On 17 December 2001, the applicant was arraigned
on the above charges, and his counsel requested and was granted a
continuance.  On 111 February 2002, the applicant consulted with legal
counsel and voluntarily requested, in writing, discharge under the
provisions of Chapter l0, AR 635-200 in lieu of trial by court-martial.  In
this request, the applicant admitted guilt to the offense, or a lesser-
included offense.  Further, the applicant indicated that he understood that
he could receive an under other than honorable conditions discharge and
that the discharge would have a significant effect on eligibility for
veteran’s benefits.  The applicant did not submit a statement in his own
behalf.  The unit commander recommended approval of an under other than
honorable conditions discharge.  On
1 March 2002, the separation authority approved the discharge with an under
other than honorable conditions discharge.  The applicant was to be reduced
to the lowest enlisted rank.

      b.  On 9 April 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 3 years, 2 months, and 29 days of
active military service in the period under review and had a total of 6
years, 6 months and 8 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
UOHC is normally considered appropriate.

                   issue of propriety to change the discharge.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infraction of discipline, the extent thereof, and the
seriousness of the offense.  The Board found that the length and quality of
the applicant’s service mitigated his misconduct.  In view of the
foregoing, the Board determined that the characterization of service was
inequitable.  Accordingly, the Board voted to grant partial relief in the
form of an upgrade of characterization of service to general, under
honorable conditions.  The Board determined that the reason for discharge
was proper and equitable and voted not to change it.

        (1)  The issue is rejected.  The Board determined that the
applicant’s misconduct diminished the quality of his service below that
meriting a fully honorable discharge.  The evidence of record shows the
applicant was charged with the commission of an offense punishable under
the Uniform Code of Military Justice (UCMJ) with a punitive discharge.  The
Board noted that, after consulting with defense counsel, the applicant
voluntarily, and in writing, requested separation from the Army in lieu of
trial by court-martial.  In doing so, the applicant admitted guilt to the
stipulated or lesser-included offenses under the UCMJ.  The Board
determined that the applicant was appropriately assigned an RE code of 4,
which indicates that the applicant was separated from his last period of
service with a nonwaivable disqualifier and that he is ineligible for
reenlistment.
