                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 17 October 2002, DA, HQ, 24th
Infantry Division (Mech) and Fort Riley, Fort Riley, KS, Orders 290-0006
released the applicant from active duty, effective 12 January 2003.  The
record contains a properly constituted DD Form 214 (Certificate of Release
or Discharge from Active Duty) which was authenticated by the applicant’s
signature.  His DD Form 214 indicates that he was released from active duty
under the provisions of Chapter 4, AR 635-200 by reason of completion of
required service, with an honorable discharge.  The applicant was
reassigned to the USAR Control Group (Reinf) for completion of his
statutory service obligation.

      b.  On 11 January 2003, the applicant was discharged.  At the time of
discharge, the applicant had completed 3 years of active military service
in the period under review and had a total of 5 years, 5 months and 24 days
of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200,
in effect at the time, set forth the basic authority for separation of
enlisted personnel.  Chapter 4 of that regulation provided, in pertinent
part, for the separation of individuals at completion of required service
(i.e., expiration term of service).

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

      b.  Equity:      The parenthetical number(s) below correspond(s) to
                   the issue number(s) on the DD Form 293, or in Part VI,
                   Paragraph 1, above.

        (1-3)  The issues are rejected.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 The Board noted that the applicant was released from active duty under the
provisions of Chapter 4, AR 635-200, by reason of completion of required
service.  His service was characterized as honorable.  He is not entitled
to an entry-level separation because he has more than 180 days of
continuous active duty.  This Board is not empowered to return former
service members to active duty.  The Board may only change the
characterization or reason for discharge.  If the applicant desires to
reenlist, he should contact the local recruiter to determine his
eligibility to reenlist.  Those individuals can best advise a former
service member as to the needs of the Army at the time, and are required to
process waivers of reentry eligibility (RE) codes.  The Board, being
convinced that the reason of discharge and the characterization of service
were both proper and equitable, voted to deny relief.
