PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Note: The evidence of record shows that on 23 October 1984,
Orders 209-6, DA, HQ, National Training Center and Fort Irwin, CA, discharged applicant from the regular Army, effective date: 24 October 1984. Applicant signed DD Form 214, indicating following facts: Character of service is a general, under honorable conditions discharge under the provisions of Chapter 13, AR 635-200, unsatisfactory performance

         b. On 24 October 1984, the applicant was discharged with a general, under honorable conditions discharge, under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance. At the time of discharge, the applicant had 3 years, 0 months, and 19 days on his current enlistment.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

 (1) The issue is accepted. The Board determined that the applicant was discharged for the sole reason of failure to meet Army weight control standards. Under current standards an honorable discharge is mandated. Accordingly, the Board voted to grant relief by changing the characterization of service to fully honorable. However, the Board found that the reason for discharge was proper and equitable and voted not to change it.
