PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 26 March 1987, the applicant was
convicted in Chatham County, Georgia, of kidnapping, rape, and giving a
false name to authorities. On 30 November 1988, DA, HQ, U.S. Army Armor
Center and Fort Knox, Kentucky, Orders 229-24 discharged the applicant from
the Regular Army, effective 14 December 1988. The record contains a
properly constituted DD Form 214 (Certificate of Release or Discharge from
Active Duty). His DD Form 214 indicates that he was discharged under the
provisions of Chapter 14, Section II, AR 635-200 by reason of civil
conviction, with a characterization of service of under other than
honorable conditions. The specific facts and circumstances pertaining to
the applicant’s discharge are not contained in the available records.
b. On 14 December 1988, the applicant was discharged. At the time
of discharge, the applicant had completed 8 years and 14 days of active
military service and accrued 66 days of lost time due to AWOL and 887 days
of lost time due to civil confinement in the period under review and had a
total of 8 years and 14 days of active military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct. Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave. Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed. Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

(5) The issue is accepted. The Board carefully examined the
applicant’s record of service during the period of enlistment under review
and heard his testimony. The applicant presented compelling evidence
showing that his civilian conviction was overturned based on the
availability of new science/technology. Given the above factors and the
applicant’s subsequent exoneration by the State of Georgia, the Board found
that the discharge is now inequitable. Accordingly, the Board voted to
grant relief in the form of an upgrade of characterization of service to
fully honorable and to change the narrative reason for separation to
Secretarial Authority. This action entails a change in RE code to 1.
