PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 18 April 2002, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with a characterization of service of honorable. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service and waiver of further rehabilitative efforts. The separation authority waived further rehabilitative efforts and directed that the applicant be separated with a characterization of service of general, under honorable conditions.

         b. On 18 June 2002, the applicant was released from active duty and returned to the USAR Control Group. At the time of his release, the applicant had completed 3 years and 9 days of active military service in the period under review.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the requirements and procedures for administrative discharge of enlisted personnel. Chapter 13 of this regulation, states in pertinent part, that separation proceedings will be initiated for soldiers without medical limitations who have two consecutive failures of the Army Physical Fitness Test. The reason for discharge will be shown as unsatisfactory performance. Service of soldiers separated because of unsatisfactory performance for failure of the Army Physical Fitness Test will be characterized as honorable or general, under honorable conditions.

(3) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as infractions of discipline, the extent thereof, and the seriousness of the offenses. Notwithstanding the applicant’s nonjudicial punishment, the Board noted that the primary basis for the applicant’s separation was his failure to meet the minimum standards of the Army Physical Fitness Test and his weight problem. Additionally, the applicant’s unit commander recommended that he receive a characterization of service of honorable. Based on these factors, the Board determined that relief is warranted. Accordingly, the Board voted to grant relief by changing the characterization of service to fully honorable.

(4) The issue is accepted. Regulations currently in effect list the reason for the applicant’s release from active duty as “Physical Standards.” Accordingly, the Board voted to change the narrative reason on the DD Form 214 to “Physical Standards” with a corresponding separation code of “LFT.”
