PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 11 March 2003, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 5-17, AR 635-200, by reason of physical conditions, not a disability, with an honorable discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement in his own behalf. The unit commander subsequently recommended separation from the service and waiver of further rehabilitative efforts. The separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a characterization of service of general, under honorable conditions.

         b. On 25 March 2003, the applicant was discharged. At the time of discharge, the applicant had completed 1 year, 3 months, and 28 days of active military service in the period under review and had a total of 2 years, 7 months and 26 days of active military service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-17 provides that a soldier may be separated for a physical or mental condition, not amounting to disability under Army Regulation 635-40, which interferes with assignment to or performance of duty. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service

 (2) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The Board noted that the applicant was properly processed for discharge under the provisions of Chapter 5, Paragraph 5-17, AR 635-200, by reason of a physical condition, not a disability. Notwithstanding the foregoing, the approving authority improperly directed that the applicant’s service be characterized as general, under honorable conditions. The evidence of record shows that the chain of command failed to inform the applicant as to the specific reason for issuing a characterization of service less than fully honorable. In view of the foregoing, the Board determined that the characterization of service was/is improper. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to fully honorable. The Board determined that the reason for discharge was both proper and equitable and voted not to change it.
