PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 28 August 1990, the applicant requested a hardship discharge under the provisions of Chapter 6, AR 635-200, due to family problems. On 26 August 1990, the unit commander recommended approval. On 10 September 1990, the separation authority approved the applicant’s request and directed that the applicant be released from Active Duty and placed in the Individual Ready Reserve with a characterization of service of honorable.

         b. On 21 September 1990, the applicant was released from Active Duty and transferred to the USAR Control Group. At the time of release, the applicant had completed 1 years, 6 months, and 15 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Chapter 6, Paragraph 6-3a (i.e., dependency) and 6-3b (i.e., hardship) provide for the separation of soldier by reason of hardship. Army Regulation 635-5-1 (Separation Program Designator (SPD) Codes), currently in effect, provides that a soldier voluntarily released from active duty and transferred to the USAR Control under the provisions of Chapter 6, Paragraph 6-3a or b, will be assigned a narrative reason for separation of “Hardship” and a separation code of “MDB.”
