                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 26 October 1990, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory
performance, with a general, under honorable conditions discharge.  He was
advised of his rights.  The applicant consulted with legal counsel, was
advised of the impact of the discharge action, and requested appearance
before an administrative separation board.  On 5 November 1990, the
intermediate commander reviewed the proposed discharge action, recommended
a general, under honorable conditions discharge, and forwarded the proposed
discharge for board action.  On 3 January 1991, board of officers met;
applicant appeared with counsel.  The board recommended separation with a
general, under honorable conditions discharge.  The final approval by the
separation authority is not contained within the record.

      b.  On 15 February 1991, the applicant was discharged.  At the time
of discharge, the applicant had completed 3 years, 7 months, and 29 days of
active military service in the period under review and had a total of 13
years,
8 months and 6 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 13 contains the policy and outlines the procedures for separating
individuals for unsatisfactory performance, to include separation for those
individuals who fail to maintain Army physical standards.  Initiation of
separation proceedings is required for individuals without medical
limitations who have two consecutive failures of the Army physical fitness
test or who are eliminated for cause from Noncommissioned Officer Education
System courses unless the responsible commander chooses to impose a bar to
reenlistment per AR 601-280.  Service of individuals separated because of
unsatisfactory performance will be characterized as honorable or under
honorable conditions as warranted by their military records.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The Board does not condone the applicant’s
misconduct; however, it determined that the characterization of service is
too harsh.  The applicant's misconduct was mitigated by service of
sufficient length and merit to warrant an upgrade of the discharge being
reviewed.  Accordingly, the Board voted to grant partial relief in the form
of an upgrade of characterization of service to fully honorable.  The Board
found that the reason for discharge was fully supported in the record, and
voted not to change it.
